    Shipowner Liability Under Section 905(b) of the Longshoremen\u27s and Harbor Workers\u27 Compensation Act: A Proposed Standard of Care

    The 1972 Amendments to the Longshoremen\u27s and Harbor Workers\u27 Compensation Act (LWHCA) greatly increased the maximum benefits to be paid to an injured longshoreman by the shipowner and, nullifying two Supreme Court decisions, permitted an injured longshoreman to maintain an action against a shipowner premised upon the unseaworthiness of the shipowner\u27s vessel. A finding of unseaworthiness would render the shipowner fully liable for any injuries that occurred. As a result of the 1972 Amendments, section 905(b) of the LHWCA provides that an injured longshoreman can recover damages against a shipowner only upon a showing of negligence. This article identifies and explores the many differing opinions of what constitutes shipowner negligence; analyzes efforts to create a uniform standard of care for shipowners; and finally proposes a standard of care for shipowners

    The development of the current global era increasingly leads to tough competition especially for the company. Currently the Brand Image is important in any company where the company has its own brand image that aims to launch sales in pursuit of profit. According to Surachman (2018), the brand image of some of the brands that can be identified but cannot be pronounced, such as special symbols, design, colours, or costumer perception of a product or service represented by its brand. The purpose of this research is to find out how big the influence of Brand Image towards the purchase of a Samsung Android phone at the outlet IT Centre in Manado. The population in this study i.e. the consumer Mobile Samsung Android IT Centre outlets in Manado. The samples used this study is as much as 100 respondents, using linear regression and correlation analysis. In the calculation in this study, researchers using SPSS software version 21, which could indicate whether there is a correlation between the two variables and how much influence Brand Image against a purchasing decision. Based on the results of the study i.e. the result value of R is the relation between meaning 0.348 brand image against the decision of the buyer is low. The value R square (coefficients determinative) 0.121. That value indicates that the decision of the buyer on the outlets IT Centre in Manado was 12.1% in influence by Samsung\u27s brand image, while the 87.9% in influence by other variables in the meticulous in this research. From the result of this research the brand has positive influents\u27 on purchasing decisions but the level of influence is very low, because the company must continue to increase its brand image

    Asteroseismology of the Hyades with K2: first detection of main-sequence solar-like oscillations in an open cluster

    The Hyades open cluster was targeted during Campaign 4 (C4) of the NASA K2 mission, and short-cadence data were collected on a number of cool main-sequence stars. Here, we report results on two F-type stars that show detectable oscillations of a quality that allows asteroseismic analyses to be performed.     Gene polymorphism of interleukin 1 and 8 in chronic gastritis patients infected with Helicobacter pylori

    Background: Epidemiological investigations have indicated that Helicobacter pylori induces inflammation in the gastric mucosa regulated by several interleukins. the genes IL1B and IL8 are suggested as key factors in determining the risk of gastritis. the aim of this paper was to evaluate the association of gene polymorphism of interleukin-1 and interleukin-8 with chronic gastrits in H. pylori infected patients. A total of 60 patients underwent endoscopic procedure. Biopsy samples were collected for urease test, histopathological and molecular exams. the DNA of theses samples was extracted for detection of H. pylori and analysis of the genes mentioned above. Patients with gastritis had a higher frequency of H. pylori-positive samples.Results: H. pylori was detected in 30/60 patients (50%) by PCR.     Design of a novel LOX-1 receptor antagonist mimicking the natural substrate

    The lectin-like oxidized low-density lipoprotein receptor-1 (LOX-1), the major receptor for oxidized low-density lipoprotein (ox-LDL) in endothelial cells, is overexpressed in atherosclerotic lesions. LOX-1 specific inhibitors, urgently necessary to reduce the rate of atherosclerotic and inflammation processes, are not yet available. We have designed and synthesized a new modified oxidized phospholipid, named PLAzPC, which plays to small scale the ligand-receptor recognition scheme. Molecular docking simulations confirm that PLAzPC disables the hydrophobic component of the ox-LDL recognition domain and allows the interaction of the l-lysine backbone charged groups with the solvent and with the charged/polar residues located around the edges of the LOX-1 hydrophobic tunnel. Binding assays, in a cell model system expressing human LOX-1 receptors, confirm that PLAzPC markedly inhibits ox-LDL binding to LOX-1 with higher efficacy compared to previously identified inhibitors

    Identifying hidden patterns in credit risk survival data using Generalised Additive Models

    Modelling patterns in credit risk using survival analysis techniques have received considerable and increasing attention over the past decade. In these models, the predictor of the hazard of default is often expressed as a simple linear combination of the risk factors. In this work, we discussed how these models can be enhanced using Generalised Additive Models (GAMs). In the GAMs framework, the predictor is formulated as a combination of flexible univariate functions of the risk factors. In this paper, we parametrise GAMs for credit risk data in terms of penalised splines, outline the implementation via frequentist and Bayesian MCMC methods, apply them to a large porfolio of credit card accounts, and show how GAMs can be used to improve not only the application, behavioural and macro-economic components of survival models for credit risk data at individual account level, but also the accuracy of predictions. From a practitioner point of view, this work highlights that some accounts may actually become more(less) attractive to the lender if flexible smooth functions are used whereas the same applicant may be denied (accepted) a loan if the linearity assumption is forced

    Incorporating heterogeneity and macroeconomic variables into multi-state delinquency models for credit cards

    Multistate delinquency models model the probability that an credit account transits from one state of delinquency to another between any two points in the life of the account. Using a large sample of credit card accounts we parametrise such models with flexible baselines defined in terms of splines, and investigate whether predictive accuracy is enhanced by the incorporation of account specific random effects as well as the incorporation of macroeconomic variables. We conclude that macroeconomic variables are statistically significant in such models, that the inclusion of random effects renders some fixed effects less statistically significant but does not enhance predictive accurac

    3D microstructure of magnesium potassium phosphate ceramics from X-ray tomography: new insights into the reaction mechanisms

    Magnesium potassium phosphate ceramics are chemically bonded ceramics employed as biomaterials, in nuclear waste encapsulation and for concrete repair. The microstructure dictates material performance and depends on the raw mix composition. Synchrotron X-ray computed microtomography was employed to describe the 3D microstructure and its time evolution during hardening and gain insights into the reaction mechanisms. Any excess water with respect to the stoichiometry of the reaction brought about an increase in porosity, but, notably, a reduction in the average pore size. Crystals filled the water ‘pockets’ in the ceramic volume by growing larger, although less densely packed, increasing the complexity of the pore shape. Platelet over elongated crystal habit was favoured. Such a change in shape is likely related to a change in reaction mechanism, as crystallization from a gel-like amorphous precursor is hindered and progressively substituted by a through-solution mechanism. It is proposed that the time evolution of the microstructure is dictated by the balance between crystallization from amorphous precursor, prevailing in relatively ‘dense’ systems (with stoichiometric water or in low excess), and water segregation, prevailing at higher water contents. The former mechanism was shown to produce an increase in porosity with time, because of the density mismatch between the amorphous and the crystalline phase
