    Lessons from New Orleans: A Stronger Role for Public Defenders in Spurring Indigent Defense Reform

    Excessive caseloads prevent public defenders from fulfilling their ethical obligations and curtail criminal defendants’ right to the effective assistance of counsel. Despite this ethical and constitutional dilemma, legislators have been reluctant to provide adequate funds for indigent defense. And because of the separation of powers, courts have been unable to force legislators’ hands. Against this backdrop, criminal defendants in states that choose not to adequately fund indigent defense face a serious risk of wrongful conviction. The Orleans Public Defenders Office (OPD) provides a case study of public defenders playing a stronger role in spurring legislative reform. In response to a funding crisis in Louisiana, the OPD refused to take new cases beyond constitutionally permissible workloads. This refusal resulted in criminal defendants being put on waiting lists for representation, which garnered national attention, gave rise to class action lawsuits against the state, and created a threat to public safety. These are governance problems that legislators prioritize over funding indigent defense. The OPD’s refusal to take new cases has been somewhat successful: in response to this crisis, the state legislature has provided additional funds to public defenders’ offices in the state. Public defenders are in a unique position to put pressure on legislators. By refusing to take new cases that would cause their workloads to be excessive, public defenders can both maintain their obligations to the profession and ensure constitutional representation for their clients

    The environment, where the changes are everyday occurrence and the competition continuous threat, forces the leading people in the organizations to look after everything that goes on inside the organizations, as well as everything that goes on outside of them. Thus, depending on the founder's capability, respectively the manager of the organization, the success of the organization can go up or down. The individuals that have entrepreneurial spirit, that know how to combine their knowledge, education and work experience with the successful guiding of the employees toward the goal, strengthen their business and open possibilities for its expansion. If under competence we imply to the knowledge of business, working experience and skills necessary for effective performance at the workplace, then undoubtedly the entrepreneur-founder in order to obtain the optimum knowledge for the business that he starts, previously has to build his competences through appropriate education and work experience. Herein we present working research conducted in order to prove the connection of the organization's success with the knowledge, skills and competences for the corresponding business of the organization's founder, particularly if the founder is also general manager of the organization. This research is conducted within the frames of the scientific and research activity of the University of Tourism and Management in Skopje, FYRO Macedonia. As a research sample 271 respondents - employees and 10 leaders of the companies included in the research. The leaders are managers and founders of the private companies. As a research technique questionnaire is used. Practical aim of the research was to use the results in order to create a basis for improving the performance of companies by developing the competencies of the management teams in them. One of the main conclusions of the research is: The manager-founder who starts up a business, needs to have optimum knowledge of the business i.e. appropriate education for the same, prior to working it in another company or otherwise acquired knowledge of relevant business

    Penelitian ini dilatarbelakangi oleh lemahnya keterampilan sosial peserta didik khususnya keterampilan berpartisipasi dalam pembelajaran, baik diskusi kelas maupun kelompoknya. Penguasaan keterampilan sosial seperti ini penting dimiliki oleh peserta didik karena akan berpengaruh pada proses pembelajaran secara keseluruhan. Metode yang digunakan dalam penelitian ini yaitu Penelitian Tindakan Kelas (Classroom Action Research) yang merujuk pada pola desain penelitian Kemmis and Mc. Taggart. Dari hasil observasi dan analisis pada ke tujuh indikator keterampilan sosial, yaitu: (1) Mendengarkan ketika orang lain bicara; (2) Bicara tidak asal-asalan; (3) Tidak cepat emosi; (4) Bicara lantang dan jelas; (5) Melibatkan diri dalam diskusi kelompok; (6) Bergiliran dalam bicara (tidak mendominasi); dan (7) Mau bicara (Tidak diam sama sekali), disimpulkan bahwa ada peningkatan keterampilan social yang signifikan setelah dilakukan tindakan sebanyak dua kali siklus dengan masing-masing siklus terdiri dari tiga kali tindakan. Pada tindakan siklus I, keterampilan social peserta didik berada pada kategori cukup dan setelah dilakukan tindakan pada siklus II, meningkat pada kategori baik

    The importance of human recourseñ management is important in every field of work and in every enterprise, especially in enterprises operating in the tourism sector. We underline this because the tourism commercial sector is mainly based and depends on qualified human potentialwhich will be correctly managed. The same applies to the question of the human resources management in Republic of Macedonia. The employees in tourism field have to be enabled and qualified to fulfil all future requests and standards connected with their working performances. The specificity of our companies included in the tourist sector is the fact that there are small companies operating according to the number of employees; in such cases, the managers commonly do not perform only the leadership function only, but in most cases there is an overlapping with the executive function. For these reasons, it is hard to discuss a classical type of management because, as we mentioned, the Macedonian companies compared to those from more developed countries, are different in their size, and therefore in their style of management

    Epigenetic valleys in the Tikves Basin in the Republic of Macedonia

    The epigenetic valleys as part of the fluvial relief are of special geomorphologic significance. As ostensibly anomalous phenomena, they mirror the inconsistent fluvial relief, i.e. a phase of adjustment of longitudinal profiles of rivers. The subject of research in this paper involved some forms of the fluvial relief in the drainage basin of the Vardar River, in the Tikves Basin, which had some predispositions to be classified as an epigenetic valleys. The necessary geological-and-lithological and morphological parameters have shown that specific segments in the river valleys in Tikves are distinguished by special physiognomy, lithology and genesis, which correspond to epigenetic valleys and gorges. Thus arguments indicated in total ten created epigenetic valleys and gorges on the level of the Tikves Basin. Seven epigenetic occurrences were formed below the neogene level, whereas three of them were formed above the neogene level
