The Rearden Problem: Defining Ownership in a Changing Landscape
This paper will address the problem that is currently being confronted by the Walt Disney World Company; who owns the creative works made from software stolen from the original creator? Furthermore, does the court’s application of the “lion’s share” theory effectively further the Constitution’s intent to promote the growth of arts and sciences? By looking at the historical progression of intellectual property law and the holdings of key cases in copyright law, this paper will distill into a summary of key concerns the jurisprudence regarding associating property rights in intellectual property. By narrowing the key considerations of the court, this paper will contend that Margaret Radin’s theory of Personhood Perspective can play an important role in solving the issue Disney is facing, as well as future problems companies may face
Electronic instrumentation of coal slurry impoundments for real-time data collection to support automated monitoring
Following the breakthrough and release of coal slurry from the Martin County Coal Corporation impoundment near Inez, Kentucky on October 11, 2000 the United States Congress requested the National Research Council (NRC) to examine ways to reduce these types of accidents. The NRC completed their study titled Coal Waste Impoundments which identified numerous areas of concern and the committee presented recommendations for improving the design, operation, and safety of coal slurry impoundments. This research addresses the National Research Council\u27s findings for introducing state-of-practice electronic instrumentation for monitoring parameters within the embankment and slurry pool area of an impoundment. This research will improve impoundment stability, safety, and environmental compliance monitoring. Previous research performed by West Virginia University (WVU) in 2003 at nineteen coal impoundments within West Virginia indicated no occurrences of electronic instrumentation in use for the real-time collection and emergency warning annunciation of important safety and environmental related parameters. The research identified that coal company operators and their design engineers were not familiar with the new instrumentation equipment and systems.;This research project has been initiated by the National Technology Transfer Center (NTTC) Coal Slurry Impoundment Project which funded WVU for the development of a prototype wireless data collection system for monitoring impoundment performance, safety, and environmental indicators at Eastern Associated Coal Corporation\u27s Rocklick Impoundment located in Greenwood, Boone County, West Virginia. The scientific accomplishments of this research as reported herein include the engineering design, instrument system fabrication, assembly, and field construction of a prototype automatic wireless data collection system for monitoring impoundment performance (weather data, piezometric water levels, pH, Specific Conductance, and Oxidation Reduction Potential)
The Evangeline Baseball League, 1934-1948: the Story of a Class D Circuit
In six chapters, numbering 163 pages, the history of the Evangeline Baseball League is related, covering the years 1934 to 1948. Included in this account is a description of the relationship between the citizens of the small towns which sponsored the teams and the management and players of the clubs, fan participation, and the economic and sociological impact of the League on the area. Emphasis is ultimately placed upon characterization of the residents of the region as the League evolved. A bibliography is included which indicates that the research performed was heavily influenced by newspapers and personal interviews. Finally, the thesis concludes that the Evangeline League, a thoroughly indigenous operation, reflected the temper and style of ths people who lived in south Louisiana during and after the Great Depression
How West Virginia daily newspapers handle errors and corrections
Media credibility and accuracy has been a topic of debate in the field of journalism for many years. This study examines the types of errors that occur most often within West Virginia\u27s daily newspapers; how these publications handle errors and corrections, and the placement of corrections and clarifications within the newspapers. This study uses mixed-methods research to find its results. Corrections and clarifications gathered over a 60-day time period were analyzed for the type of error corrected as well as if the error was attributed. Newspaper editors were surveyed about how their publications handle corrections and their perceptions of the types) of errors that occur most often
Design of OsII-based Sensitizers for Dye-Sensitized Solar Cells:Influence of Heterocyclic Ancillaries
A series of OsII sensitizers (TFOS-x, in which x=1, 2, or 3) with a single 4,4′-dicarboxy-2,2′-dipyridine (H2dcbpy) anchor and two chelating 2-pyridyl (or 2-pyrimidyl) triazolate ancillaries was successfully prepared. Single-crystal X-ray structural analysis showed that the core geometry of the OsII-based sensitizers consisted of one H2dcbpy unit and two eclipsed cis-triazolate fragments; this was notably different from the RuII-based counterparts, in which the azolate (both pyrazolate and triazolate) fragments are located at the mutual trans-positions. The basic properties were extensively probed by using spectroscopic and electrochemical methods as well as time-dependent density functional theory (TD-DFT) calculations. Fabrication of dye-sensitized solar cells (DSCs) was then attempted by using the I−/I3−-based electrolyte solution. One such DSC device, which utilized TFOS-2 as the sensitizer, showed promising performance characteristics with a short-circuit current density (JSC) of 15.7 mA cm−2, an open-circuit voltage of 610 mV, a fill factor of 0.63, and a power conversion efficiency of 6.08 % under AM 1.5G simulated one-sun irradiation. Importantly, adequate incident photon-to-current conversion efficiency performances were observed for all TFOS derivatives over the wide spectral region of 450 to 950 nm, showing a panchromatic light harvesting capability that extended into the near-infrared regime. Our results underlined a feasible strategy for maximizing JSC and increasing the efficiency of DSCs
Investigation of a new bis(carboxylate)triazole-based anchoring ligand for dye-sensitised solar cell chromophore complexes
A novel anchoring ligand for dye-sensitised solar cell chromophoric complexes, 1-(2,2’-bipyrid-4-yl)-1,2,3-triazole-4,5-dicarboxylic acid (dctzbpy), is described. The new dye complexes [Ru(bpy)2(dctzbpy)][PF6]2 (AS16), [Ir(ppy)2(dctzbpy)][PF6] (AS17) and [Re(dctzbpy)(CO)3Cl] (AS18) were prepared in a two stage procedure with intermediate isolation of their diester analogues, AS16-Et2, AS17-Et2 and AS18-Et2 respectively. Electrochemical analysis of AS16-Et2, AS17-Et2 and AS18-Et2 reveal reduction potentials in the range -1.50 to -1.59 V (vs Fc+/Fc) which is cathodically shifted with respect to that of the model complex [Ru(bpy)2(dcbH2)]2+ (1) (Ered = -1.34 V, dcbH2 = 2,2’-bipyridyl-4,4’dicarboxylic acid). This therefore demonstrates that the LUMO of the complex is correctly positioned for favourable electron transfer into the TiO2 conduction band upon photoexcitation. The higher energy LUMOs for AS16 to AS18 and a larger HOMO-LUMO gap result in blue-shifted absorption spectra and hence reduced light harvesting efficiency relative to their dcbH2 analogues. Preliminary tests on TiO2 n-type and NiO p-type DSSCs have been carried out. In the cases of the Ir(III) and Re(I) based dyes AS17 and AS18 these show inferior performance to their dcbH2 analogues. However, the Ru(II) dye AS16 (η = 0.61 %) exhibits significantly greater efficiency than 1 (η = 0.1 %). In a p-type cell AS16 shows the highest photovoltaic efficiency (η = 0.028 %), almost three times that of cells incorporating the benchmark dye coumarin C343
Near-IR sensitization of wide band gap oxide semiconductor by axially anchored Si-naphthalocyanines
Near-IR dye sensitized solar cells are very interesting due to their potential applications in panchromatic cells, semi-transparent windows and in tandem cells. In this work we show the utilization of axially anchored Si-naphthalocyanine dye in the spectral sensitization of TiO2 nanostructured photoelectrodes. We report the first successful evaluation of a naphthalocyanine in the production of sensitized photocurrent with maximum incident photon to current efficiency (IPCE) at λ 790 n
The role of disclosure of social shopping rewards in social buzz
Purpose – Social shopping relies on word-of-mouth, with marketers turning to social shopping rewards (SSRs) to generate social buzz. According to US regulatory bodies, these types of rewards, if considered endorsements, must be disclosed. Yet, little is known about the impact of disclosure of SSRs. To address this gap, this study aims to examine the impact of disclosure of SSRs on consumerresponses.Design/methodology/approach – Respondents were randomly assigned to three experimentalconditions via an online survey. The “no disclosure” condition featured a hypothetical friend’s tweet of a product (n 91). The “disclosure” conditions featured the same tweet, either with the words“Sponsored Tweet” in a boxed tweet (n 50) or with a hashtag “#Sponsored” (n 48). All respondents completed a questionnaire designed to address the hypotheses.Findings – No differences between the disclosure conditions were found, thus they were combined and compared to the non-disclosure condition. Of the 13 hypotheses, 9 were sustained by significant correlations. Disclosure to consumers that a product review was sponsored by a marketer strengthens the relationships between certain model constructs, i.e. between dual source credibility and attitude toward the message and between attitude toward the message and attitude toward the brand.Originality/value – This study is the first to empirically test the impact of disclosure of SSRs on consumer responses in a social shopping context. Findings provide marketers and practitioners with a solution to complying with regulatory requirements in ways that do not hurt consumer responses tosocial buz
