    The Teaching of Procedure Across Common Law Systems

    What difference does the teaching of procedure make to legal education, legal scholarship, the legal profession, and civil justice reform? This first of four articles on the teaching of procedure canvasses the landscape of current approaches to the teaching of procedure in four legal systems—the United States, Canada, Australia, and England and Wales—surveying the place of procedure in the law school curriculum and in professional training, the kinds of subjects that “procedure” encompasses, and the various ways in which procedure is learned. Little sustained reflection has been carried out as to the import and impact of this longstanding law school subject. Through a comparative approach, this series of articles explores what difference the approach a particular jurisdiction has chosen to adopt makes for legal education, legal scholarship, the practice of law and the profession, and to civil justice reform in our legal system. En quoi l’enseignement de la procédure civile modifi e-t-il les études juridiques, la recherche juridique, la profession d’avocat et la réforme de la justice civile? Ce premier de quatre articles sur l’enseignement de la procédure dresse le tableau de l’approche actuellement utilisée dans quatre systèmes juridiques – aux États-Unis, au Canada, en Australie, en Angleterre et au Pays de Galles – et se penche sur la place qu’occupe la procédure dans le programme des facultés de droit et dans la formation professionnelle, les matières qui constituent la « procédure » et les diverses façons d’apprendre la procédure.     Galaxy Zoo Green Peas: discovery of a class of compact extremely star-forming galaxies

DOI: 10.1111/j.1365-2966.2009.15383.xWe investigate a class of rapidly growing emission line galaxies, known as 'Green Peas', first noted by volunteers in the Galaxy Zoo project because of their peculiar bright green colour and small size, unresolved in Sloan Digital Sky Survey imaging. Their appearance is due to very strong optical emission lines, namely [O iii]λ5007 Å, with an unusually large equivalent width of up to ∼1000 Å. We discuss a well-defined sample of 251 colour-selected objects, most of which are strongly star forming, although there are some active galactic nuclei interlopers including eight newly discovered narrow-line Seyfert 1 galaxies. The star-forming Peas are low-mass galaxies (M∼ 108.5–1010 M⊙) with high star formation rates (∼10 M⊙ yr−1) , low metallicities (log[O/H]+ 12 ∼ 8.7) and low reddening [ E(B−V) ≤ 0.25 ] and they reside in low-density environments. They have some of the highest specific star formation rates (up to ∼10−8 yr−1 ) seen in the local Universe, yielding doubling times for their stellar mass of hundreds of Myr. The few star-forming Peas with Hubble Space Telescope imaging appear to have several clumps of bright star-forming regions and low surface density features that may indicate recent or ongoing mergers. The Peas are similar in size, mass, luminosity and metallicity to luminous blue compact galaxies. They are also similar to high-redshift ultraviolet-luminous galaxies, e.g. Lyman-break galaxies and Lyα emitters, and therefore provide a local laboratory with which to study the extreme star formation processes that occur in high-redshift galaxies. Studying starbursting galaxies as a function of redshift is essential to understanding the build up of stellar mass in the Universe.Peer reviewe

    Serological response to 13-valent pneumococcal conjugate vaccine in children and adolescents with perinatally acquired HIV infection

    BACKGROUND: Children with perinatally acquired HIV (paHIV) remain at an increased risk of pneumococcal infection despite highly active antiretroviral therapy (HAART). Beyond infancy, responses to pneumococcal conjugate vaccine (PCV) remain under-investigated. There are currently no published data on serological response to 13-valent PCV (PCV13) in the HIV-infected populations. METHODS: We measured pneumococcal serotype-specific IgG in 48 paHIV-infected child patients (CP), 27 young adult healthy controls (AHC) and 30 child healthy controls (CHC). Opsonophagocytic assay (OPA) titres for three PCV13-exclusive serotypes were measured in a subset of children. Serotype-specific IgG was repeated 1 and 6 months following PCV13 vaccination of CP and AHC groups. OPA titres for four serotypes were measured at the 1-month time-point. RESULTS: The majority of CP, CHC and AHC had serotype-specific IgG above 0.35 μg/ml at baseline, although OPA activity was undetectable for two of the three serotypes studied. Baseline IgG concentrations were significantly lower in CP than AHC for a proportion of serotypes and were strongly predictive of responses to vaccine. After adjusting for baseline, postvaccination IgG concentrations were comparable, although responses to some serotypes were impaired for CP. OPA correlated well with IgG after vaccination. Detectable HIV viral load was associated with significantly lower IgG concentration and OPA titre. CONCLUSION: Children with paHIV mount a robust serological response to PCV13 for most but not all vaccine serotypes. Viral load suppression with HAART and higher baseline IgG concentration are associated with higher postvaccination antibody levels. This has implications for HAART treatment and vaccination practices

    The development of a theory-based intervention to promote appropriate disclosure of a diagnosis of dementia

    Background: The development and description of interventions to change professional practice are often limited by the lack of an explicit theoretical and empirical basis. We set out to develop an intervention to promote appropriate disclosure of a diagnosis of dementia based on theoretical and empirical work. Methods: We identified three key disclosure behaviours: finding out what the patient already knows or suspects about their diagnosis; using the actual words 'dementia' or 'Alzheimer's disease' when talking to the patient; and exploring what the diagnosis means to the patient. We conducted a questionnaire survey of older peoples' mental health teams (MHTs) based upon theoretical constructs from the Theory of Planned Behaviour (TPB) and Social Cognitive Theory (SCT) and used the findings to identify factors that predicted mental health professionals' intentions to perform each behaviour. We selected behaviour change techniques likely to alter these factors. Results: The change techniques selected were: persuasive communication to target subjective norm; behavioural modelling and graded tasks to target self-efficacy; persuasive communication to target attitude towards the use of explicit terminology when talking to the patient; and behavioural modelling by MHTs to target perceived behavioural control for finding out what the patient already knows or suspects and exploring what the diagnosis means to the patient. We operationalised these behaviour change techniques using an interactive 'pen and paper' intervention designed to increase intentions to perform the three target behaviours. Conclusion : It is feasible to develop an intervention to change professional behaviour based upon theoretical models, empirical data and evidence based behaviour change techniques. The next step is to evaluate the effect of such an intervention on behavioural intention. We argue that this approach to development and reporting of interventions will contribute to the science of implementation by providing replicable interventions that illuminate the principles and processes underlying change.This project is funded by UK Medical Research Council, Grant reference number G0300999.     An investigation into the collection, measurement and use of quality costs within a high volume production environment

    The thesis describes an investigation into the collection and measurement of quality costs. It goes on to explain the manner in which this information was presented and used as an integral part of a specific (high volume manufacturing) company's total quality drive. Finally, it demonstrates how the cost of quality can help to identify and direct efforts to improve quality. Guidelines are given for the collection and analysis of quality cost data within the packaging industry. A comprehensive literature survey covering issues directly related to the objectives of the research, and peripheral issues of importance, was carried out. Literature on case studies for the promotion of quality were also included 'in the survey. The survey was confined to English language publications, using a list of keywords relating to money (i.e. cost, profit, economic, etc.) and topics ranging from the use of "quality improvement" as a business strategy to the quality-related costs associated with specific manufacturing operations. The search was primarily confined to quality related literature. This literature was reviewed and discussed in the light of the research experience, some gaps in the literature and information available were identified. These are discussed as a part of the development of a dedicated methodology, within the final chapter. A three stage, action research methodology was adopted. Action research encompasses direct involvement in organisational change whilst providing an increase in the knowledge base for a specific topic. This was the best possible option as the project specification relates to a practical problem with theoretical relevance. The main advantage of action research is that it is carried out in real-time and produces a concrete result, putting something of real practical worth back into an organisation. Four practical costing models were identified: (i) Prevention, Appraisal, Failure Model; (ii) Process Cost Model; (iii) Economic Balance of Quality (Optimum Quality Cost) Model; and (iv) Total Loss to Society (Quadratic Loss Function) Model. A host firm was used to test (i) and (ii). These two models were chosen because they exhibited certain characteristics. They both form part of British Standard - BS 6143, have had some publicity in the form of articles within professional journals, and have been utilised within both manufacturing and service industries to provide quality costing data. The British Standard (BS) 6143: Parts 1 (1991) and 2 (1990) was used as the primary guide. A detailed analysis of the applicability of both models was carried out, with necessary modifications being made to suit the host firms' particular industry (plastic injection moulding). This analysis is reported and discussed at length. Among the key conclusions are that quality costing can have a, very positive effect upon an organisations' quality improvement drive, and that the careful development of a specific cost model (in this instance the P.A.F. model) and a methodology for employing it, within a larger framework, should be considered essential. Further conclusions are that all organisations are at various stages in the use of formal measurement systems. As such, the identification of what stage an organisation has progressed to, and the determination of how they should proceed, is important for forward progress in the use of quality measurement systems. A conceptual framework has been designed for this purpose. A set of guidelines for quality cost collection and analysis within the packaging industry (high volume manufacturing) was created. As was a matrix to show an organisations' current place and potential development within certain key parameters, for example: i) company awareness, ii) costing models used, iii) measurement systems in place. The methodology developed for the host company is being used within other companies from the same corporate group. This is allowing refinement of the original model to take place. Other recommendations for further study are proposed in order to establish the validity of the above measurement system framework. This research has contributed to the existing knowledge base by trailing and modifying existing models within a specific environment, and through the development of a conceptual framework for assessing an organisations quality measurement system development. The direct contribution to the host company, in terms of practical and theoretical assistance has been considerable. This is fully detailed within the thesis

    The influence of paediatric HIV infection on circulating B cell subsets and CXCR5+ T helper cells

    Antiretroviral therapy (ART) only partially restores HIV-induced alterations in lymphocyte populations. We assessed B and T cell phenotypes in a cohort of children from a single centre in the United Kingdom with perinatally acquired HIV compared to healthy controls. The majority of HIV infected children (44 of 56) were on fully suppressive combination ART. Children with perinatally acquired HIV had significantly lower memory B and CD4(+) CD45RO(+) CXCR5(+) [follicular T helper cell (Tfh)-like] T cell percentages. Detectable viraemia was associated with higher CD21(-) (activated and exhausted/tissue-like memory) B cells. A greater proportion of life spent on suppressive ART was associated with higher memory B cell percentages. These results suggest that early and sustained suppressive ART may preserve B and T cell phenotypes in perinatally acquired HIV and limit deficits in humoral immunity. A lower proportion of circulating Tfh-like cells in HIV infected children appears to be independent of HIV treatment history and ongoing HIV viraemia and warrants further investigation

    3D pic simulations of collisionless shocks at lunar magnetic anomalies and their role in forming lunar swirls

In this paper a review of the observations of lunar mini-magnetospheres is compared quantifiably with theoretical kinetic-scale plasma physics and 3D particle-in-cell simulations. The aim of this paper is to provide a complete picture of all the aspects of the phenomena and to show how the observations from all the different and international missions interrelate. The analysis shows that the simulations are consistent with the formation of miniature (smaller than the ion Larmor orbit) collisionless shocks and miniature magnetospheric cavities, which has not been demonstrated previously. The simulations reproduce the finesse and form of the differential proton patterns that are believed to be responsible for the creation of both the "lunar swirls" and "dark lanes." Using a mature plasma physics code like OSIRIS allows us, for the first time, to make a side-by-side comparison between model and space observations. This is shown for all of the key plasma parameters observed to date by spacecraft, including the spectral imaging data of the lunar swirls. The analysis of miniature magnetic structures offers insight into multi-scale mechanisms and kinetic-scale aspects of planetary magnetospheres.Publisher PDFPeer reviewe

    An XQuery-based Model Transformation Language

    In this paper we propose a framework for model transformation in XQuery. Our proposal aims to provide the elements for using XQuery as a transformation language. With this aim, our framework provides a mechanism for automatically obtaining an XQuery library for a given meta-model. Meta-models are defined as XML schemas, and the XQuery library serves to query and create elements of an XML Schema. Transformations abstract from XML representation, in the sense of, elements from meta-models are encapsulated by XQuery functions. We have also studied how to use our framework for model validation. Source and target models and transformations are validated by considering constraints.
