    Status of the tiger beetle Cicindela hirticollis Say (Coleoptera: Cicindelidae) in New York City and on Long Island, New York, USA

    Coastal species are under considerable threat from recreational activities and climate change. The tiger beetle Cicindela hirticollis Say (Coleoptera: Cicindelidae) was recorded historically from 30 locations along the shores of New York City and Long Island, New York. We conducted surveys for extant populations of this species at 40 sites from 1989 to 2010. Adults of C. hirticollis were found at 13 beaches. Only four sites had 40 or more adults of C. hirticollis active at the time the beach was surveyed. No beetles were detected on the large coastal beaches that were formerly occupied by this species. Many coastal beaches of New York receive heavy human foot and vehicle traffic and are therefore unlikely to provide suitable habitat for C. hirticollis without a shift in beach management that recognizes the potential of some beaches as wilderness systems capable of supporting the full array of beach-dependent species

    Spatial and temporal variability and long-term trends in skew surges globally

    Storm surges and the resulting extreme high sea levels are among the most dangerous natural disasters and are responsible for widespread social, economic and environmental consequences. Using a set of 220 tide gauges, this paper investigates the temporal variations in storm surges around the world and the spatial coherence of its variability. We compare results derived from two parameters used to represent storm surge: skew surge and the more traditional, non-tidal residual. We determine the extent of tide-surge interaction, at each study site, and find statistically significant (95% confidence) levels of tide-surge interaction at 59% of sites based on tidal level and 81% of sites based on tidal-phase. The tide-surge interaction was strongest in regions of shallow bathymetry such as the North Sea, north Australia and the Malay Peninsula. At most sites the trends in the skew surge time series were similar to those of non-tidal residuals, but where there were large differences in trends, the sites tended to have a large tidal range. Only 13% of sites had a statistically significant trend in skew surge, and of these approximately equal numbers were positive and negative. However, for trends in the non-tidal residual there were significantly more negative trends. We identified 8 regions where there were strong positive correlations in skew surge variability between sites, which meant that a regional index could be created to represent these groups of sites. Despite strong correlations between some regional skew surge indices, none were significant at the 95% level, however, at the 80% level there was significant positive correlation between the north-west Atlantic—south and the North Sea. Correlations between the regional skew surge indices and climate indices only became significant at the 80% level, where Ni?o 4 was positively correlated with the Gulf of Mexico skew surge index and negatively correlated with the east Australia skew surge index. The inclusion of autocorrelation in the calculation of correlation greatly reduced their significance, especially in the short time-series used for the regional skew surge indices. Skew surge improved the representation of storm surge magnitudes, and therefore allows a more accurate detection of changes on secular and inter-annual time scales

    Tides exert a major control on the coastal zone by influencing high sea levels and coastal flooding, navigation, sediment dynamics, and ecology. Therefore, any changes to tides have wide ranging and important implications. In this paper, we uniquely assess secular changes in 15 regularly used tidal levels (five high water, five low water and five tidal ranges), which have direct practical applications. Using sea level data from 220 tide gauge sites, we found changes have occurred in all analyzed tidal levels in many parts of the world. For the tidal levels assessed, between 36% and 63% of sites had trends significantly different (at 95% confidence level) from zero. At certain locations, the magnitude of the trends in tidal levels were similar to trends in mean sea level over the last century, with observed changes in tidal range and high water levels of over 5 mm/yr and 2 mm/yr, respectively. More positive than negative trends were observed in tidal ranges and high water levels, and vice versa for low water levels. However we found no significant correlation between trends in mean sea level (MSL) and any tidal levels. Spatially coherent trends were observed in some regions, including the north-east Pacific, German Bight and Australasia, and we also found that differences in trends occur between different tidal levels. This implies that analyzing different tidal levels is important. Because changes in the tide are widespread and of similar magnitude to MSL rise at a number sites, changes in tides should be considered in coastal risk assessments

    Label-invariant models for the analysis of meta-epidemiological data.

    Rich meta-epidemiological data sets have been collected to explore associations between intervention effect estimates and study-level characteristics. Welton et al proposed models for the analysis of meta-epidemiological data, but these models are restrictive because they force heterogeneity among studies with a particular characteristic to be at least as large as that among studies without the characteristic. In this paper we present alternative models that are invariant to the labels defining the 2 categories of studies. To exemplify the methods, we use a collection of meta-analyses in which the Cochrane Risk of Bias tool has been implemented. We first investigate the influence of small trial sample sizes (less than 100 participants), before investigating the influence of multiple methodological flaws (inadequate or unclear sequence generation, allocation concealment, and blinding). We fit both the Welton et al model and our proposed label-invariant model and compare the results. Estimates of mean bias associated with the trial characteristics and of between-trial variances are not very sensitive to the choice of model. Results from fitting a univariable model show that heterogeneity variance is, on average, 88% greater among trials with less than 100 participants. On the basis of a multivariable model, heterogeneity variance is, on average, 25% greater among trials with inadequate/unclear sequence generation, 51% greater among trials with inadequate/unclear blinding, and 23% lower among trials with inadequate/unclear allocation concealment, although the 95% intervals for these ratios are very wide. Our proposed label-invariant models for meta-epidemiological data analysis facilitate investigations of between-study heterogeneity attributable to certain study characteristics

    The life blood of religious educational institutions is their doctrinal statements and codes of conduct that set standards for employee and student life. The purpose of this paper is to examine the freedom of religious educational institutions to make employment decisions related to three homosexuality related areas: sexual orientation, same-sex sexual activity outside marriage, and same-sex marriage. At the core of the discussion is the basic question whether religious educational institutions have a protected right to enforce doctrinal statements or codes of conduct addressing one or more of these areas. This paper will examine legal issues related to the ability of religious educational institutions to declare and enforce their religious beliefs regarding same-sex relationships. This discussion involves a balancing of important interests. On one side is the interest of government in prohibiting discrimination, retaliation, and harassment against persons engaged in protected activity. On the other side are the free exercise, free speech and expressive association rights of religious educational institutions to express and enforce their religious beliefs

    Standard of Care for Students with Disabilities: The Intersection of Liability Under the IDEA and Tort Theories

    This article explores issues of legal liability for school personnel where students with disabilities are injured in school settings or cause injuries to employees and other students in schools. While questions related to legal liability are varied, they tend to fall within two broad areas: standard of care relating to injuries to or by students; and, standard of care for employees working with students with or training others to work with students with disabilities. In both areas, the legal issue revolves around the concept of heightened standard of care, especially where framed by the language of students\u27 IEPs (Individualized Education Programs). To what extent should injuries to, or caused by, students with disabilities be considered within the context of a heightened standard of care where an IEP reveals a student\u27s propensity to cause injuries or to be vulnerable to injuries? Where services provided to students with severe disabilities as part of their IEPs have life-saving components to them (such as suctioning tracheotomy tubes or ambubag venting ), should the responsibility for providing those services or for training or supervising others to provide the services be assessed by a heightened standard of care
