    Sword or Shield? Setting Limits on SLUSA’s Ever-Growing Reach

    Concerned by the overwhelming presence of vexatious federal securities-fraud class actions, Congress passed the Private Securities Litigation Reform Act of 1995 to increase the procedural burden plaintiffs would face in filing these nonmeritorious suits. Instead of being deterred, plaintiffs simply brought their suits in state court. Congress responded with the Securities Litigation Uniform Standards Act of 1998 (SLUSA), making federal court the exclusive venue for securities-fraud class actions. However, Congress expressly saved from SLUSA\u27s reach claims that were traditionally brought in state court under corporate law through the Delaware carve-out. Though this exemption was meant to protect the historic dual federal-state securities-regulation regime, recent appellate court opinions have stretched SLUSA\u27s reach too far, leaving plaintiffs incapable of bringing many traditional state-law claims essential to the proper policing of corporate law regardless of the forum. This Note addresses the implications of such a broad reading of SLUSA and advocates a two-pronged approach that will simultaneously effectuate SLUSA\u27s purpose while still preserving these important state-law claims. By looking to the heart of a complaint, courts can best effectuate congressional intent both to limit problematic litigation practices and to preserve the important role federalism plays in the securities-law context

    Can a nudge keep you warm? Using nudges to reduce excess winter deaths: insight from the Keeping Warm in Later Life Project (KWILLT)

    Nudges are interventions that aim to change people's behaviour through changing the environment in which they choose rather than appealing to their reasoning. Nudges have been proposed as of possible use in relation to health-related behaviour. However, nudges have been criticized as ethically dubious because they bypass peoples reasoning and (anyway) are of little help in relation to affecting ill-health that results from social determinants, such as poverty. Reducing the rate of excess winter deaths (EWDs) is a public health priority; however, EWD seems clearly to be socially determined such that nudges arguably have little role. This article defends two claims: (i) nudges could have a place in tackling even the heavily socially determined problem of EWD. We draw on evidence from an empirical study, the Keeping Warm in Later Life Project (KWILLT), to argue that in some cases the risk of cold is within the person’s control to some extent such that environmental modifications to influence behaviour such as nudges are possible. (ii) Some uses of behavioural insights in the form of nudges are acceptable, including some in the area of EWD. We suggest a question-based framework by which to judge the ethical acceptability of nudges

    Moving to Extremal Graph Parameters

    Which graphs, in the class of all graphs with given numbers n and m of edges and vertices respectively, minimizes or maximizes the value of some graph parameter? In this paper we develop a technique which provides answers for several different parameters: the numbers of edges in the line graph, acyclic orientations, cliques, and forests. (We minimize the first two and maximize the third and fourth.) Our technique involves two moves on the class of graphs. A compression move converts any graph to a form we call fully compressed: the fully compressed graphs are split graphs in which the neighbourhoods of points in the independent set are nested. A second consolidation move takes each fully compressed graph to one particular graph which we call H(n,m). We show monotonicity of the parameters listed for these moves in many cases, which enables us to obtain our results fairly simply. The paper concludes with some open problems and future directions

    The PROUST radar: First results

    Two campaigns took place in 1984 with the PROUST Radar operating in a bistatic mode, the transmitting antenna pointing at the vertical and the receiving one, 1 deg. off the vertical axis. The antenna beam intersection covers an altitude range between 3 and 9 km. The first of these campaigns are analyzed. The results analyzed show the capability of the PROUST Radar to measure the turbulent parameters and study the turbulence-wave interaction. In its present configuration (bistatic mode and 600 m vertical resolution), it has been necessary to make some assumptions that are known not to be truly fulfilled: homogeneous turbulence and constant vertical wind intensity over a 600-m thickness. It is clear that a more detailed study of the interaction between wave and turbulence will be possible with the next version of PROUST Radar (30-m altitude resolution and monostatic mode) that will soon be achieved

    Mid-IR period-magnitude relations for AGB stars

    Asymptotic Giant Branch variables are found to obey period-luminosity relations in the mid-IR similar to those seen at K_S (2.14 microns), even at 24 microns where emission from circumstellar dust is expected to be dominant. Their loci in the M, logP diagrams are essentially the same for the LMC and for NGC6522 in spite of different ages and metallicities. There is no systematic trend of slope with wavelength. The offsets of the apparent magnitude vs. logP relations imply a difference between the two fields of 3.8 in distance modulus. The colours of the variables confirm that a principal period with log P > 1.75 is a necessary condition for detectable mass-loss. At the longest observed wavelength, 24 microns, many semi-regular variables have dust shells comparable in luminosity to those around Miras. There is a clear bifurcation in LMC colour-magnitude diagrams involving 24 micron magnitudes.Comment: 5 pages, 4 figure
