La civilisation de la common law

The author examines the current process in which the common law tradition is drawing doser to that of the civil law, a process given major impetus by the important reforms of the common law in the XIXth century. The rapprochement is taking place at the level of specific rules (though important differences remain in this regard) and especially at the level of basic concepts and institutions. He sets out the principal characteristics of the common law throughout its history, notably the dominance of institutions over the substantive law, and then examines the principal instrument of the rapprochement, which is the articulation of the substantive law of the common law.L'auteur constate que la tradition de la common law se rapproche de celle du droit civil, surtout depuis les grandes réformes de la common law effectuée au XIXe siècle. Le rapprochement a lieu au niveau des règles précises (bien que d'importantes différences existent toujours à ce niveau) et surtout sur le plan des conceptions de base et les institutions. Il trace ainsi les caractéristiques fondamentales de la common law pendant la plupart de son histoire, pour ensuite trouver l'élément essentiel de ce rapprochement dans l'articulation du droit substantiel de la common law.Glenn H.Patrick.
