    The Terry doctrine, which grants a police officer the authority to stop and frisk based on his or her reasonable suspicion rather than probable cause, was created by the Supreme Court at a time when the nation con- fronted a particular moment of violent racial strife. Since Terry was decided, the Supreme Court has continued to expand the reach of the doctrine—which opened the door for potential abuse. Existing data is increasingly proving that the loosening of constitutional standards is causing substantial harms to people of color nationwide. This article joins the existing scholarly discussion surrounding this decision to suggest one additional tool that might be used to address the racial impact of the Terry doctrine. In particular, this Article proposes that police authority to stop suspects on nothing more than reasonable suspicion be limited to cases in which an officer reasonably believes the suspect is engaged in something more than a mere possessory offense. The proposal is consistent with much of the Supreme Court’s past language and will not substantially undercut police efforts to combat violent crime. In addition, this proposal will not be administratively burdensome since it would only require a police officer to articulate what about the suspect made him believe he was engaged in something other than a possessory criminal offense, which is not all that different from what police officers are currently required to do as a matter of internal policy. It is time to stop Terry to avoid the further erosion of rights caused by Terry stops

    Roughness effects in turbulent forced convection

    We conducted direct numerical simulations (DNSs) of turbulent flow over three-dimensional sinusoidal roughness in a channel. A passive scalar is present in the flow with Prandtl number Pr=0.7Pr=0.7, to study heat transfer by forced convection over this rough surface. The minimal channel is used to circumvent the high cost of simulating high Reynolds number flows, which enables a range of rough surfaces to be efficiently simulated. The near-wall temperature profile in the minimal channel agrees well with that of the conventional full-span channel, indicating it can be readily used for heat-transfer studies at a much reduced cost compared to conventional DNS. As the roughness Reynolds number, k+k^+, is increased, the Hama roughness function, ΔU+\Delta U^+, increases in the transitionally rough regime before tending towards the fully rough asymptote of κm1log(k+)+C\kappa_m^{-1}\log(k^+)+C, where CC is a constant that depends on the particular roughness geometry and κm0.4\kappa_m\approx0.4 is the von K\'arm\'an constant. In this fully rough regime, the skin-friction coefficient is constant with bulk Reynolds number, RebRe_b. Meanwhile, the temperature difference between smooth- and rough-wall flows, ΔΘ+\Delta\Theta^+, appears to tend towards a constant value, ΔΘFR+\Delta\Theta^+_{FR}. This corresponds to the Stanton number (the temperature analogue of the skin-friction coefficient) monotonically decreasing with RebRe_b in the fully rough regime. Using shifted logarithmic velocity and temperature profiles, the heat transfer law as described by the Stanton number in the fully rough regime can be derived once both the equivalent sand-grain roughness ks/kk_s/k and the temperature difference ΔΘFR+\Delta \Theta^+_{FR} are known. In meteorology, this corresponds to the ratio of momentum and heat transfer roughness lengths, z0m/z0hz_{0m}/z_{0h}, being linearly proportional to z0m+z_{0m}^+, the momentum roughness length [continued]...Comment: Accepted (In press) in the Journal of Fluid Mechanic

    Vertical Coherence of Turbulence in the Atmospheric Surface Layer: Connecting the Hypotheses of Townsend and Davenport

    Statistical descriptions of coherent flow motions in the atmospheric boundary layer have many applications in the wind engineering community. For instance, the dynamical characteristics of large-scale motions in wall-turbulence play an important role in predicting the dynamical loads on buildings, or the fluctuations in the power distribution across wind farms. Davenport (Quarterly Journal of the Royal Meteorological Society, 1961, Vol. 372, 194-211) performed a seminal study on the subject and proposed a hypothesis that is still widely used to date. Here, we demonstrate how the empirical formulation of Davenport is consistent with the analysis of Baars et al. (Journal of Fluid Mechanics, 2017, Vol. 823, R2) in the spirit of Townsend's attached-eddy hypothesis in wall turbulence. We further study stratification effects based on two-point measurements of atmospheric boundary-layer flow over the Utah salt flats. No self-similar scaling is observed in stable conditions, putting the application of Davenport's framework, as well as the attached eddy hypothesis, in question for this case. Data obtained under unstable conditions exhibit clear self-similar scaling and our analysis reveals a strong sensitivity of the statistical aspect ratio of coherent structures (defined as the ratio of streamwise and wall-normal extent) to the magnitude of the stability parameter

    Productivity in American Whaling: The New Bedford Fleet in the Nineteenth Century

    From the end of the War of 1812 until the Civil War the New Bedford whaling fleet grew spectacularly; thereafter it declined, equally spectacularly. By the end of the century New Bedford's day was over. During the 88 years of this period, the technical configuration of the fleet, the hunting grounds visited, and the types of whales pursued all changed dramatically, and more than once. The literature on whaling suggests that the collapse of the industry was due, in part, to declining productivity, occasioned by the disappearance of the whales (because of over-hunting) and the deterioration of the quality of labor. The shifts in the composition of the fleet are viewed, chiefly, as the result of efforts by whalemen to overcome their problems. In this paper, productivity data (superlative indexes), by voyage, are employed in multiple regression analysis to trace the relationships between the changes in the composition of the fleet and productivity. The propositions that declining labor quality and whale stocks had important consequences for productivity are subjected to test, while the impacts of technical changes on productivity are measured.

    Congressional Representation of Black Interests: Recognizing the Importance of Stability

    The relationship between black constituency size and congressional support for black interests has two important attributes: magnitude and stability. Although previous research has examined the first characteristic, scant attention has been directed at the second. This article examines the relationship between district racial composition and congressional voting patterns with a particular emphasis on the stability of support across different types of votes and different types of districts. We hypothesize that, among white Democrats, the influence of black constituency size will be less stable in the South, owing in part to this region’s more racially divided constituencies. Examining LCCR scores from the 101st through 103rd Congress, we find that this expectation is largely confirmed. We also find that, among Republicans, the impact of black constituency size is most stable—albeit negligible in size— in the South. We conclude by discussing the implications of these findings for the relative merits of “influence districts” and “majority minority” districts
