Article 50 does allow Britain to negotiate a transitional period
The PM intends to negotiate a transitional period after March 2019, during which people, businesses and services would have time to adapt to Brexit while the current regulatory framework is maintained. But it is still unclear how Britain will do this. Federico Ortino and Holger Hestermeyer (King’s College London) argue that Article 50 allows the UK to postpone the beginning of the withdrawal agreement until a later date – perhaps March 2021. This would give the government valuable time to implement Brexit
Personal Jurisdiction for Internet Torts: Towards an International Solution
As an introduction to the issue of Internet tort jurisdiction, Part I will recount the Yahoo! case, the most divisive case on the issue recently. Parts II and III will give an overview of the current law on Internet tort jurisdiction in two different legal systems: the United States and Germany. They will show that several recent cases in both countries have applied targeting approaches as advocated by Michael Geist and Rufus Pichler. However, insecurity remains and jurisprudence is far from consistent. Part IV will argue that insecurity about Internet jurisdiction could be reduced significantly if countries were to commit themselves in an international convention to abide by a targeting approach along with guidelines for relevant criteria. Such an international law approach would limit the risk for website hosts of being dragged into court anywhere in the world. Unfortunately, an opportunity to pursue such a regime during the negotiations at the Hague Convention on Jurisdiction and Foreign Judgements in Civil and Commercial Matters ( Judgements Project ) has been lost with the collapse of those negotiation
How Brexit Will Happen:A Brief Primer on EU Law and Constitutional Law Questions Raised by Brexit
Towards a UK Trade Policy Post-Brexit:The Beginning of a Complex Journey
Trade has had a stunning return to the spotlight since the results of the Brexit referendum were announced. While it is much too early to speak of failure or success of the UK's trade policy, we allege that the current debate shows a lack of understanding of modern international trade law and policy. This in turn leads to a lack of appreciation of the tasks ahead for the UK. The limited aim of this short article is to point out the scope of some of the key challenges and the complexities that the UK will face on the road towards a post-Brexit trade policy. We consider a proper appreciation of these complexities to be vital for a transparent, fair and inclusive formulation of the UK's trade policies, which will determine not only the UK's economic fate, but also the UK's laws and many of its domestic policies for decades to come
On Brexit, transition, customs partnership and max fac - a drama in four acts
The Brexit process has had its share of surprising twists and turns. But even seasoned observers were taken by surprise recently when the Sun reported that "Brexiteers urge Theresa May to extend the transition period". Experts have long agreed that the transition period currently provided for in the Withdrawal Agreement is unlikely to be long enough to successfully negotiate a broad Free ...Trade Agreement (read Association Agreement) between the UK and the EU. So is this news evidence that rationality is returning to the Brexit debate? Sadly, no, writes Holger Hestermeyer (King’s College London). Rather, we are witnessing a surreal play – a drama in four acts
