First, on the lawless adjudicator. The question I want to pose is this: Why is it so hard for the legal academy - and the legal profession - to come to grips with the bare logic of the charge, much less the case, that Vere acted lawlessly, and therefore criminally, and indeed murderously, when he willfully distorted the governing law, so as to execute Billy? Why has this quite specific legal claim not received more of a hearing? Is it because Weisberg was not sufficiently considerate in his communication of this idea? On first blush that seems implausible: It is one thing, after all, to argue syllogistically that Claggart is Christ, that Claggart is a villain, and that therefore Christ is a villain-one can see why that claim may require considerate communication - but the indictment of the fictional Vere in a nineteenth century novella? Why has it proven so hard for the academy to hear Weisberg\u27s claim that Vere is a murderer? Here is the syllogism: Vere was charged with the duty to uphold the law, he betrayed the law and his duty to apply it in order to execute an innocent man, and he did it knowingly, intentionally, and with plenty of malice aforethought, and for the most profoundly personal, political reasons. Therefore, Vere is a lawless adjudicator, a dissembler, a criminal, a murderer. Does that straightforward legal argument - that an adjudicator is a man to whom the power to declare what the law is has been delegated; that an adjudicator might be a criminal, and might achieve criminal ends, through dissembling, misrepresenting, or perverting legal texts, and thereby through breaching a trust - itself require considerate communication? Has our faith in adjudication reached such absurd heights that the lawless or criminal adjudicator has become an unthinkable oxymoron? Or, have our expectations dropped so low that the phrase lawless adjudicator has become redundant, so self evident, that the presentation, the claim, that an adjudicator is lawless, is just a trite, banal, and unnecessary restatement of a mode of being always and already present in courts of law

In the recent World Men\u27s Basketball Championships in Indianapolis, Team USA found out painfully that the international game is very different from what they play at home and that the gap between USA Basketball and the rest of the world has been closing. While the United States\u27 losses might have a significant impact on how the country will prepare for the 2004 Olympics in Athens and on how Americans train youngsters to play basketball, their teachings go beyond basketball. The international harmonization process is a game with different rules, different officials, and players with different visions and mindsets. By watching how players interact with rules, officials, and other players, one therefore could gain insight into globalization and the international harmonization process. Team USA\u27s recent loss might be a painful lesson to Americans, but it provides a beneficial lesson to all of us who are involved in intellectual property and international trade

NSFW: An Empirical Study of Scandalous Trademarks

This project is an empirical analysis of trademarks that have received rejections based on their “scandalous” nature. It is the first of its kind. The Lanham Act bars registration for trademarks that are “scandalous” and “immoral.” While much has been written on the morality provisions in the Lanham Act, this piece is the first scholarly project that engages an empirical analysis of the Section 2(a) rejections based on scandalousness; it contains a look behind the scenes at how the morality provisions are applied throughout the trademark registration process. This study analyzes which marks are being rejected, what evidence is being used to reject them, and who the applicants are. Our data pays particularly close attention to the evidence used to determine whether a mark is scandalous. We also consider whether this bar is effective at removing these marks from the consumer marketplace

Rewriting Fair Use and the Future of Copyright Reform

This essay describes a social practices approach to the production of creative expression, as a construct to guide reform of copyright law. Specifically, it reimagines copyright's fair use doctrine by basing its statutory text explicitly on social practices. It argues that the social practices approach is consistent with the historical development of the fair use doctrine and with the policy goals of copyright law, and that the approach should be recognized in the text of the statute as well as in judicial applications of fair use

Creativity and Culture in Copyright Theory

Creativity is universally agreed to be a good that copyright law should seek to promote, yet copyright scholarship and policymaking have proceeded largely on the basis of assumptions about what it actually is. When asked to discuss the source of their inspiration, individual artists describe a process that is intrinsically ineffable. Rights theorists of all varieties have generally subscribed to this understanding, describing creativity in terms of an individual liberty whose form remains largely unspecified. Economic theorists of copyright work from the opposite end of the creative process, seeking to divine the optimal rules for promoting creativity by measuring its marketable byproducts. But these theorists offer no particular reason to think that marketable byproducts are either an appropriate proxy or an effective stimulus for creativity (as opposed to production), and more typically refuse to engage the question. The upshot is that the more we talk about creativity, the more it disappears from view. At the same time, the mainstream of intellectual property scholarship has persistently overlooked a broad array of social science methodologies that provide both descriptive tools for constructing ethnographies of creative processes and theoretical tools for modeling them

Bu çalışmada, Gökkuşağı alabalıklarında enfeksiyonoluşturan Ichthyophthirius multifiliis’infarklı bölgelerden izole edilmiş saha suşlarının genotipik yapıları temelindeimmundominant özellik gösteren rekombinant immobilizan antijenlerini(i-antijen) kodlayan genlerin bakteriyel ekspresyon sistemine klonlanarakeksprese ve karakterize edilmeleri, antijenik profillerinin ortaya çıkarılmasıve aşı adayı olabilecek rekombinant antijenlerin elde edilmesi amaçlanmıştır.&nbsp;Çalışmada 2018 ve 2019 yıllarının Temmuz ve Ağustos ayları arasında Gökkuşağıalabalığı yetiştiriciliğinin yoğun yapıldığı Samsun, Rize, Kayseri, Elazığ,Burdur, Antalya ve Muğla illerinde bulunan işletmeler ziyaret edilerek balıkpopülasyonları üzerinde saha araştırmaları yürütülmüş ve I. multifiliis ile enfekte bulunan balıklardan ilgili protokolleregöre izolasyon gerçekleştirilmiştir. Laboratuvara uygun solüsyonlar ve soğukzincir altında intikal ettirilen örneklerden cDNA ve gDNA izolasyonlarıgerçekleştirilmiştir. I. multifiliis i-antijengen lokusunun amplifikasyonu amacıyla optimum primer dizaynı için ön çalışmalaryürütülmüş ve hedef gen bölgeleri uygun amplifikasyon koşullarında PCR’daçoğaltılmıştır. Elde edilen amplikonlar agaroz jel üzerinden saflaştırılmıştır.Multiple gen lokusu sekanslarının belirlenebilmesi amacıyla ilgili pürifiyeamplikonlar pJET 1.2 plazmit vektörüne CloneJET PCR cloning kit (Thermo FisherScientific) kullanılarak klonlanmış ve katı besi yerinde belirlenenkolonilerden rekombinant plazmid DNA izolasyonları gerçekleştirilmiştir. Rekombinantplazmidler spesifik primerlerle çift yönlü olarak sekanslanmış vekromotogramlar De Novo Assemble üzerinden işlenerek hedef insert sekanslarvektör plazmid DNA’sı içerisinden çıkarılmış ve konsensüs sekanslar eldeedilmiştir. İlgili primerlerin i-antijen gen lokusu içerisinde çoğalttığı fragmentlerinbelirlenebilmesi amacıyla PCR ürünleri ayrıca yeni nesil dizileme teknolojisi (NGS)kullanılarak işlenmiş ve elde edilen dizilimlerin gen veri tabanlarındakimevcut tüm i-antijen gen lokusları ile filogenetik ilişkileri araştırılmıştır.Tüm bu araştırmalar sonucu karakterize edilen i-antijen genlerinin ekspreseettiği proteinlerin rekombinant olarak eldesi için çalışmalargerçekleştirilmiştir. Aşı adayı potansiyeli olabilecek bazı lokusların bakteriyelekspresyon sistemine aktarımı için kodon optimizasyonları yapılarak pET-32a(+)ekspresyon plazmid DNA’sına (Novagen) klonlanması gerçekleştirilmiştir. Eldeedilen rekombinant plazmitler E. colikompotent BL21(DE3) hücrelerine transforme edilerek optimum koşullardaekspresyon çalışmaları yürütülmüş ve ekspresyon etkinliği SDS-PAGE ve WesternBlot analizleri ile belirlenmiştir. Eksprese edilen rekombinant i-antijenproteinleri afinite kromotografi kulanılarak saflaştırılmış ve immunreaktiflikleri Western Blot analizleri ile tespit edilmiştir.&nbsp;Çalışmada,Elazığ, Rize ve Muğla illerinde ziyaret edilen işletmelerdeki Gökkuşağıalabalıklarında deri ve solungaçlarından hazırlanan preparatların mikroskobikincelemeleri ile I. multifiliisenfeksiyonunun yaygın olduğu görülmüştür. İlgili bölgelerden elde edilen I. multifiliis suşlarına ait cDNA vegDNA izolatlarının i-antijen gen lokusunun dizayn edilen pirmerlerle PCR’daamplifiye edilmesi sonucu 1200-1300 bp büyüklüğünde amplikonlar saptanmıştır.Pürifiye amplikonların klonlanması sonucu ilgili izolatlara ait açık okumaçerçevesi (ORF) sekanslarının analizinde birbirleriyle %38,3-58,8 arasındafarklılık gösteren 4 farklı i-antijen izoformu tespit edilmiştir. Bu izoformlararasında bir antijenik lokusun (ImulTR1-iant) her üç ildeki alabalıkpopülasyonlarından izole edilen I.multifiliis suşlarında da var olduğu NGS analizlerinde görülmüştür.ImulTR1-iant ORF sekansı ayrıca Amerika Birleşik Devletleri’nde alabalıklardanizole edilmiş bir i-antijen izoformuyla %83,3 identiklik gösterirken, diğertespit edilen izoformlara ait sekansların GenBank veri tabanında mevcuti-antijen sekanslarından oldukça farklı olduğu belirlenmiştir. Araştırmadarekaombinant i-antijen eldesi için yaygın belirlenen ImulTR1-iant izolatıüzerinden analizler yürütülmüştür. Bu izoformu kodlayan gen bölgesinin 1263bpbüyüklüğünde olduğu ve ORF’nin 420 amino asitten teşekkül ettiğibelirlenmiştir. ORF amino asit sekanslarının in-slico analizlerde 42,552 kDabüyüklüğünde bir proteini eksprese ettiği, bu proteinin sitoplazmik olduğu vetransmembran bölge içermediği tespit edilmiştir. Ayrıca ilgili ORF sekansıiçerisinde uzunluğu 7-22aa arasında değişen 21 antijenik bölge olduğubelirlenmiştir. Kodon optimizasyonu yapılmış olan ImulTR1-iant izoformuna ait pET-32a(+)rekombinant plazmitinin E. colikompotent BL21(DE3) hücrelerine transformasyonu ve ekspresyonu sonrasındayapılan SDS-PAGE analizlerinde in-silico analiz sonuçlarına paralel olarakyaklaşık 43kDa’luk protein jel üzerinde görüntülenmiştir. İlgili rekombinantprotein afinite kromotografide HisTrap FF crude (GE Healthcare) kolonlarıkullanılarak saflaştırılmış ve pürifiye rekombinant antijenin immun-reaktifliğiWestern-Blot analizleriyle gösterilmiştir.&nbsp;ErciyesÜniversitesi Bilimsel Araştırma Projeleri Birimi tarafından TOA-2017-7742 kodnumarasıyla desteklenen bu çalışma ile Türkiye’de gökkuşağı alabalıklarındasorun oluşturan ve ekonomik kayıplara yol açan I. multifiliis suşlarına karşı biyoteknolojik aşı geliştirilmesinoktasında aşı adayı olabilecek immobilizan antijenler üzerine özgün veriler sağlanmıştır.Elde edilen aşı adayı rekombinant antijenlerin etkinliğini ortaya koymanoktasında laboratuvar ve saha şartlarında immunizasyon ve çelınç enfeksiyondenemeleri için yeni proje çalışmaları planlanmaktadır.</style

Direct calculation of the critical Casimir force in a binary fluid

We show that critical Casimir effects can be accessed through direct simulation of a model binary fluid passing through the demixing transition. We work in the semi grand canonical ensemble, in slab geometry, in which the Casimir force appears as the excess of the generalized pressure, $P_{\bot}-n\mu$. The excesses of the perpendicular pressure, $P_{\bot}$, and of $n\mu$, are individually of much larger amplitude. A critical pressure anisotropy is observed between forces parallel and perpendicular to the confinement direction, which collapses onto a universal scaling function closely related to that of the critical Casimir force
