Bioethics and autonomy from Perruche caseforms of discrimination between procreation and prenatal diagnosis

Partiendo de la premisa de que el binomio discriminación-procreación no es un fenómeno nuevo, podría afirmarse que esa relación ha cobrado más fuerza en la actualidad gracias a la aplicación de nuevas técnicas biomédicas como el diagnóstico genético y prenatal. Las consecuencias de esta relación se analizan en el presente trabajo a través de un conocido caso judicial francés del año 2002: el caso Perruche. Este caso concreto pone de manifiesto cómo un error médico sobre el diagnóstico genético prenatal lleva a la vulneración de la autonomía de la madre de Nicolás Perruche, ya que dicho error le impidió ejercer su legítimo derecho a la interrupción voluntaria del embarazo por motivos eugenésicos. Lo que parece más complicado de sostener en términos lógicos es la posible vulneración “del derecho a no nacer” del que, supuestamente, es titular el niño nacido tras ese error médico, pues lleva a cuestionar, inevitablemente, la propia existencia e identidad de Nicolás Perruche.Starting from the premise that the binomial discrimination-procreation is not a new phenomenon, we could affirm that actually it had acquired more vigour thanks to the applications of new biomedical techniques such as genetic diagnostic prenatal. The consequences of this relation are analysed, in this article, through of the famous French judicial case in 2002: the Perruche case. This case reveals how a medical mistake about the genetic prenatal diagnosis leads to violation of Nicolas Perruche’s mother autonomy, as this mistake impeded to exercise her right to abort by a eugenic question. What seems to be more complicated to support in logical terms is the possible violation of “the right not to be born”, whose titular is the baby that medical mistake leads to questioning the Nicolas Perruche`s existence and identity
