    The Doctrine of Collateral Estoppel in Parole Revocation

    In recent years courts have shown more recognition of the rights of parolees and probationers. Spurred by a Supreme Court decision that certain due process protections were applicable to parole revocation procedures, revocation hearings are now providing parolees and probationers some of the procedural protections available to criminal defendants at trial. Policy considerations have dictated, however, that the protections available at revocation hearings must fall far short of conferring upon the accused the full panoply of rights due a defendant at trial. As a result of the Supreme Court\u27s emphasis on the difference between revocation hearings and criminal proceedings, lower courts have held that some constitutional protections available to defendants at trial do not apply at revocation hearings. Thus, the exclusionary rule has been held inapplicable to revocation hearings. This is in contrast to a recent district court decision, Standlee v. Rhay, where it was held that because of the punitive nature of a revocation hearing, it should be treated in some respects as equivalent to a criminal proceeding. These contrasting results are not as inconsistent as they may seem at first glance, but may be harmonized, to some extent, through an analysis of the principles underlying the respective doctrines. Although revocation hearings often present both exclusionary rule and collateral estoppel problems, these are essentially distinct legal concepts

    The development of new spacecraft camera systems to be used in conjunction with CCD sensors is reported. A brief overview of the science objectives and engineering constraints which influence the design of cameras for deep space is followed by a review of two current development programs, one leading to a line scan imager and the other to an area array frame camera. For each of these, a general description of the imager is given. It is evident that currently available CCDs fall short of requirements in some respects

    Marginal Abatement Costs and Marginal Welfare Costs for Greenhouse Gas Emissions Reductions: Results from the EPPA Model

    Abstract and PDF report are also available on the MIT Joint Program on the Science and Policy of Global Change website (http://globalchange.mit.edu/).Marginal abatement cost (MAC) curves, relationships between tons of emissions abated and the CO2 (or GHG) price, have been widely used as pedagogic devices to illustrate simple economic concepts such as the benefits of emissions trading. They have also been used to produce reduced form models to examine situations where solving the more complex model underlying the MAC is difficult. Some important issues arise in such applications: (1) are MAC relationships independent of what happens in other regions? (2) are MACs stable through time regardless of what policies have been implemented in the past?, and (3) can one approximate welfare costs from them? This paper explores the basic characteristics of MAC and marginal welfare cost (MWC) curves, deriving them using the MIT Emissions Prediction and Policy Analysis (EPPA) model. We find that, depending on the method used to construct them, MACs are affected by policies abroad. They are also dependent on policies in place in the past and depend on whether they are CO2-only or include all GHGs. Further, we find that MACs are, in general, not closely related to MWCs and therefore should not be used to derive estimates of welfare change. It would be a great convenience if a reduced-form response of a more complex model could be used to reliably conduct empirical analysis of climate change policy, but it appears that, at least as commonly constructed, MACs may be unreliable in replicating results of the parent model when used to simulate GHG policies. This is especially true if the policy simulations differ from the conditions under which the MACs were simulated. Care is needed to derive MACs under conditions closely related to the policy under consideration. In such a circumstance they may provide approximate estimates of CO2 or GHG prices for a given policy constraint.     Fast Single-Charge Sensing with an rf Quantum Point Contact

    We report high-bandwidth charge sensing measurements using a GaAs quantum point contact embedded in a radio frequency impedance matching circuit (rf-QPC). With the rf-QPC biased near pinch-off where it is most sensitive to charge, we demonstrate a conductance sensitivity of 5x10^(-6) e^(2)/h Hz^(-1/2) with a bandwidth of 8 MHz. Single-shot readout of a proximal few-electron double quantum dot is investigated in a mode where the rf-QPC back-action is rapidly switched.Comment: related papers available at http://marcuslab.harvard.ed

    The electrical conductivities of the DSS-13 beam-waveguide antenna shroud material and other antenna reflector surface materials

    A significant amount of noise temperature can potentially be generated by currently unknown dissipative losses in the beam waveguide (BWG) shroud. The amount of noise temperature contribution from this source is currently being studied. In conjunction with this study, electrical conductivity measurements were made on samples of the DSS-13 BWG shroud material at 8.420 GHz. The effective conductivities of unpainted and painted samples of the BWG shroud were measured to be 0.01 x 10(exp 7) and 0.0036 x 10(exp 7) mhos/m, respectively. This value may be compared with 5.66 x 10(exp 7) mhos/m for high conductivity copper

    Maximal physiological responses to deep and shallow water running.

    The maximal physiological responses to treadmill running (TMR), shallow water running (SWR) and deep water running (DWR) while wearing a buoyancy vest were compared in 15 trained male runners. Measurements included oxygen consumption (VO2 max), respiratory exchange ratio (RER) and heart rate (HR). Treadmill running elicited VO2 max and HRmax, which were higher than the peaks attained in both water tests (p < 0.01). VO2 peak averaged 83.7 and 75.3% of VO2 max for SWR and DWR respectively. Peak HR for SWR and DWR were 94.1 and 87.2% of the HRmax reached in the TMR. RER responses were similar between the three modalities. The observations suggest that the training stimulus provided by water is still adequate for supplementary training. While SWR is potentially an efficient method of maintaining cardiovascular fitness, it needs to be investigated further to establish if it is a viable technique for the injured athlete to employ

    Are you serious? From fist bumping to hand hygiene: considering culture, context and complexity in infection prevention intervention research

    Infection prevention is an under-resourced research and development topic, with limited evidence for practice in the most basic of measures. A survey of IPS R&D members indicated that what might appear to be simple interactions and interventions in healthcare, such as hand shaking and hand hygiene, should be considered complex interventions taking account of behaviour at the individual and social level as well as contextual factors. Future studies need to be designed utilising comprehensive approaches, for example, the Medical Research Council complex interventions framework, tailored to the country and more local cultural context, if we are to be serious about evidence for infection prevention and control practice

    Rapid Single-Shot Measurement of a Singlet-Triplet Qubit

    We report repeated single-shot measurements of the two-electron spin state in a GaAs double quantum dot. The readout scheme allows measurement with fidelity above 90% with a 7 microsecond cycle time. Hyperfine-induced precession between singlet and triplet states of the two-electron system are directly observed, as nuclear Overhauser fields are quasi-static on the time scale of the measurement cycle.
