The Nature of Cima Dome
In the Mojave Desert of southeasternmost California is a remarkably
smooth, symmetrical rock-alluvial dome which takes its name
from Cima on the Union Pacific Railroad. Lawson (1915, pp. 26, 33)
cited Cima Dome as a prime example of a panfan, but Thompson
(1929, p. 550) later showed that its upper part is bare rock. Davis
(1933, pp. 240-243) considered it a fine example of a convex desert
dome evolved from back-wearing of a fault block, but this concept
is contradicted by the geological relations (Hewett, 1954), which
throw more light on the nature and origin of Cima Dome than do
geomorphological theories
Teaching the Basic Ethics Class Through Simulation: The Northwestern Program in Advocacy and Professionalism
The Northwestern University School of Law created and published a set of materials for teaching the basic ethics course principally through the simulation method. Burns provides a very compressed summary of the underlying program, describes the classes themselves and the mix of teaching methods professors employ, and briefly discusses the program materials
Earth science field work: Role and status
This essay contends that the outstanding contributions currently being made to the earth sciences by theoretical and laboratory endeavors increase rather than decrease the need for sound field observations. The presentation is strongly prejudiced in favor of field studies and, accordingly, invites critical examination by skeptical minds
Bayesian computational methods
In this chapter, we will first present the most standard computational
challenges met in Bayesian Statistics, focussing primarily on mixture
estimation and on model choice issues, and then relate these problems with
computational solutions. Of course, this chapter is only a terse introduction
to the problems and solutions related to Bayesian computations. For more
complete references, see Robert and Casella (2004, 2009), or Marin and Robert
(2007), among others. We also restrain from providing an introduction to
Bayesian Statistics per se and for comprehensive coverage, address the reader
to Robert (2007), (again) among others.Comment: This is a revised version of a chapter written for the Handbook of
Computational Statistics, edited by J. Gentle, W. Hardle and Y. Mori in 2003,
in preparation for the second editio
Crawford’s Impact on Hearsay Statements in Domestic Violence and Child Sexual Abuse Cases
This Essay examines the important ancillary doctrines that need to be developed in the wake of Crawford v. Washington (2004) and the testimonial statement approach to Confrontation Clause analysis to ensure that when confrontation is provided it in fact satisfies the requirements of the Clause. More than just some opportunity to cross-examine is required. The witness must be asked to make a public accusation in his or her direct testimony rather than simply being made available for questioning by defense counsel. A public accusation in not simply an after-thought of the right; rather, both it and cross-examination are central components. Whether confrontation occurs in the present proceeding or a prior one, a public accusation is required at one point in the case. When the witness is unavailable at trial and confrontation is satisfied by what occurred in the prior proceeding, the government must likewise present the accuser for the opportunity for cross-examination at that proceeding to be sufficient. In addition, the government must put something at risk, and the hearing must have consequences. To claim the defendant has been confronted by providing an opportunity for cross-examination which will likely only harm the defendant by allowing otherwise inadmissible incriminating evidence to be admitted at trial is inadequate to satisfy the Confrontation Clause
