    Waqf Land as an Alternative for Implementing the Land Reform Program in Indonesia

    To overcome the problem of unequal land ownership, the concept of waqf land has recently been initiated as an alternative to implementing land reform. This article examines the arguments for the idea of waqf land from its jurisprudential aspect and proposes the positive legal framework necessary to implement it. This study uses a normative legal research method using two approaches, namely the statutory approach and the conceptual approach. The results of this research conclude that waqf land as an alternative for implementing land reform is very possible considering that the aim of both is to realize the welfare of the people equally. However, the implementation of waqf land as an alternative to land reform must still follow fiqh of waqf procedures and be aligned with land reform objectives

    This research focused on determining the impact of metacognitive strategies on the teaching-learning process of 6th-grade students at the León De Febres Cordero Educational Unit from the parish of San Juan. The problem addressed was related to the limited implementation and understanding of these strategies by teachers, which restricts the development of more autonomous and conscious learning. A mixed-methods approach was employed, combining surveys, interviews, and observation checklists to collect data on the application of metacognitive strategies in the classroom. The results revealed that, although strategies such as self-assessment and planning are used occasionally, their systematic application is limited due to a lack of specialized training. Despite this, it was found that integrating these strategies, in combination with a supportive environment and active methodologies, contributes to greater understanding and academic performance. The conclusions highlight the importance of providing specific training in metacognition to teachers to maximize the benefits of these practices. La problemática abordada se relacionó con la limitada implementación y comprensión de estas estrategias por parte de los docentes, lo que restringe el desarrollo de un aprendizaje más autónomo y consciente. Se empleó una metodología mixta que combinó encuesta, entrevista y fichas de observación para recolectar datos sobre la aplicación de estrategias metacognitivas en el aula. Los resultados revelaron que, aunque las estrategias como la autoevaluación y la planificación son usadas de manera ocasional, su aplicación sistemática es limitada debido a la falta de capacitación especializada. A pesar de esto, se constató que la integración de estas estrategias, en combinación con un ambiente de confianza y metodologías activas, contribuye a una mayor comprensión y rendimiento académico. Las conclusiones destacan la importancia de proporcionar formación específica en metacognición a los docentes para maximizar los beneficios de estas prácticas. La investigación evidenció que una adecuada implementación de estrategias metacognitivas puede transformar el proceso de enseñanza-aprendizaje, promoviendo una mayor autonomía y eficacia en el rendimiento estudiantil

Haryono No. 169 Malang e-mail: [email protected]   Abstrak Potensi lahan gambut wilayah Indonesia sebagai luas lahan gambut terluas se Asia Tenggara. Badan Restorasi Gambut dan Mangrove (BRGM) lembaga nonstruktural. Daerah yang menjadi wilayah binaan BRGM ialah Jambi. Desa Bhakti Idaman dengan kekayaan lokal pinang dan kelapa menjadi penopang hidup masyarakat. BUMDesa Bhakti Idaman juga turut memberikan kesejahteraan terhadap perekonomian masyarakat. Namun, BUMDesa tersebut dirasa belum optimal disamping adanya kehadriran BRGM. Tujuan penelitian ini untuk mengetahui seberapa efektif pembentukan BUMDesa dan upaya yang seharusnya dilakukan dalam pembentukan BUMDesa. Metode yang digunakan yaitu penelitian yuridis empiris dengan pendekatan sosialogi hukum. Efektivitas BUMDesa diukur dari teori soerjono soekanto yaitu faktor hukum belum memiliki peraturan desa khusus tentang BUMDes, faktor penegakan, Kepala Desa belum menegakkan peraturan terkait BUMDes secara terperinci, Faktor sarana prasarana, BUMDes Bhakti Idaman belum memiliki kantor operasional secara permanen, faktor budaya mengolah secara mentah tanpa bantuan alat, faktor masyarakat terbiasa menjual hasil-hasilnya kepada datuk. Rumusan kedua terkait dengan hambatan yang terjadi antara BRGM dengan pemerintah desa yang mana BRGM lebih berfokus pada lingkungan lahan gambut, sedangkan pemerintah desa sedang mengembangkan BUMDesa untuk kesejahteraan masyarakat. Hambatan lain pada kondisi akses jalan yang sulit, jenis usaha yang belum dipilih yang cocok bagi BUMDes dan persoalan market penjualan. Pada rumusan masalah kedua untuk pembentukan BUMDesa dapat mengacu pada Undang-Undang Nomor 6 Tahun 2014 tentang Desa, Peraturan Pemerintah Nomor 11 Tahun 2021. Kata Kunci: Badan Usaha Milik Desa, Efektivitas, Badan Restorasi Gambut dan Mangrove   Abstract Peatlands in Indonesia are the largest in Southeast Asia. Mangrove and Peat Restoration Agency (henceforth referred to as BRGM) is a non-structural body, covering Jambi. Bhakti Idaman village is home to betel nut and coconut plantations serving as the source of the livelihood of the locals. Village-Owned Enterprises of Bhakti Idaman village also contribute to the economic well-being in the area, but they do not operate optimally notwithstanding the presence of BRGM. This research aims to find out to what extent the effectiveness of the establishment of the enterprises has been and what measures should be taken to establish the enterprises. This research employed an empirical-juridical method and a socio-legal approach. The effectiveness of the enterprises is to be seen from the theoretical perspective of Soerjono Soekanto, implying that the legal factor does not have any specific regulation governing the enterprises in the village. The issues also comprise enforcement that the village head has not specifically performed regarding the enterprises, in addition to other factors such as infrastructure and facilities, the absence of permanent offices for Village-Owned Enterprises in Bhakti Idaman, the cultural factor that may need natural cultivation without tool assistance, and social factors where the locals sell the products to Datuk. The second research problem is linked to the impeding factors between BRGM and the village government. In this issue, the BRGM focuses more on peatlands, while the concern of the government lies in the well-being of the locals. Other problems in this context also include difficult road access, unselected businesses that suit the enterprises, and marketing and sale issues. The establishment of the enterprises could refer to Law Number 6 of 2014 concerning Village and the Government Regulation Number 11 of 2021.
