Executive Reorganization: Report to the Montana Legislative Assembly
This historically-important document, the 300-page “Report to the Montana Legislative Assembly from the Montana Commission on Executive Reorganization (December 1970)” was the product of 1½ years of activity of the Commission and its staff. It presented to the 1971 Legislature the executive branch organizational framework that resulted a major change in Montana law and state governmental structure embodied in the Executive Reorganization Act - Chapter 272, Laws of Montana, 1971 - Title 82A, R.C.M. 1947. Today Montana’s current executive branch structure substantially reflects the recommendations of this report from the Commission which was chaired by Governor Forrest H. This proposed statement of position provides guidance for financial reporting by entities that have filed petitions with the Bankruptcy Court and expect to reorganize as going concerns under Chapter 11 of title 11 of the United States Code. It recommends that all such entities report the same way while reorganizing under Chapter 11, with the objective of reflecting their financial evolution. To do that, their financial statements should distinguish transactions and events that are directly associated with the reorganization from the operations of the ongoing business as it evolves. The statement recommends that, on emergence from Chapter 11, entities meeting specified criteria adopt fresh start reporting since, in substance, the creditors have acquired the entities.
