    Global standards of Constitutional law : epistemology and methodology

    Just as it led the philosophy of science to gravitate around scientific practice, the abandonment of all foundationalist aspirations has already begun making political philosophy into an attentive observer of the new ways in which constitutional law is practiced. Yet paradoxically, lawyers and legal scholars are not those who understand this the most clearly. Beyond analyzing the jurisprudence that has emerged from the expansion of constitutional justice, and taking into account the development of international and regional law, the ongoing globalization of constitutional law requires comparing the constitutional laws of individual nations. Following Waldron, the product of this new legal science can be considered as ius gentium. This legal science is not as well established as one might like to think. But it can be developed on the grounds of the practice that consists in ascertaining standards. As abstract types of best “practices” (and especially norms) of constitutional law from around the world, these are only a source of law in a substantive, not a formal, sense. They thus belong to what I should like to call a “second order legal positivity.” In this article I will undertake, both at a methodological and an epistemological level, the development of a model for ascertaining global standards of constitutional law

    Catching-up and falling behind knowledge spillover from American to German machine tool makers

    In our days, German machine tool makers accuse their Chinese competitors of violating patent rights and illegally imitating German technology. A century ago, however, German machine tool makers used exactly the same methods to imitate American technology. To understand the dynamics of this catching-up process we use patent statistics to analyze firms? activities between 1877 and 1932. We show that German machine tool makers successfully deployed imitating and counterfeiting activities in the late 19th century and the 1920s to catchup to their American competitors. The German administration supported this strategy by stipulating a patent law that discriminated against foreign patent holders and probably also by delaying the granting of patents to foreign applicants. Parallel to the growing international competitiveness of German firms, however, the willingness to guarantee intellectual property rights of foreigners was also increasing because German firms had now to fear retaliatory measures in their own export markets when violating foreign property rights within Germany

    Surface magnetism is believed to be the main driver of coronal heating and stellar wind acceleration. Coronae are believed to be formed by plasma confined in closed magnetic coronal loops of the stars, with winds mainly originating in open magnetic field line regions. In this Chapter, we review some basic properties of stellar coronae and winds and present some existing models.     Bacterial Bio-indicators of Marcellus Shale Activities in Pennsylvania: A Molecular Ecology Survey

    The practice of hydraulic fracking has increased over the years especially in Pennsylvania where most of the subterraneous gas-rich Marcellus Shale formations are located. Our previous work showed that headwater streams in proximity to hydraulic fracking operations have significantly different bacterial assemblages as compared to un-impacted streams in central PA. Aquatic bacterial communities are of great importance because they are often the ‘first-responders’ to environmental perturbations. We are interested in which bacteria become enriched, as this might serve as robust biomarkers of fracking, and can potentially biodegrade constituents of fracking fluids. In this study, we plan to expand upon our previous work to identify additional sentinel bacterial taxa in other areas in PA (Northeast and Southwest) heavily impacted by fracking. Water and sediment samples have been collected from Northern Pennsylvania (n=31) and Southwestern (n=11) regions upstream and downstream of fracking activities. Bacterial community profiles of these samples were generated via high-throughput sequencing of the 16S rRNA, a robust phylogenetic marker for bacterial identification. The data generated provide a snapshot of all bacteria taxa present and their relative abundance. Thus, differences in bacterial community structure between impacted and un-impacted environments can help glean which bacterial taxa are responding to environmental perturbations associated with fracking. This research can help us generate a list of potential bioindicators of nascent fracking activities and can be used to help track impacts and bioremediation potential within environmental scenarios
