    Practical application of a model for assessing the criticality of railway infrastructure elements

    Rail transport is an important sub-sector of transport infrastructure. Disruption of its operation due to emergencies can result in a reduction in functional parameters of provided services with consequent impacts on society. Identifi cation of critical elements of this system enables its timely and effective protection. On that ground, the article presents a draft model for assessing the criticality of railway infrastructure elements. This model uses a systems approach and multicriteria semi-quantitative analysis with weighted criteria for calculating the criticality of individual elements of the railway infrastructure. In the conclusion, it presents a practical application of the proposed model including the discussion of results

    Competence development of young entrepreneurs through educational innovations

    The questions regarding interactive methods of teaching, self-studying, active learning, as well as an implementation of a competency-based approach into study process, have been actively discussed by educational experts, authorities, scholars and teachingpractitioners during the last decade. Probably, the main issue is to encourage students to participate in classroom activities and to promote successful learner-tutor cooperation. The research was aimed to evaluate the progress in entrepreneurial competencies perceived by students, participating in a specific 2-days long entrepreneurship workshop. The workshop content and schedule was designed within the framework of the international project «Strategic Partnership for Innovation and Development of Entrepreneurship».The format of the organized workshops was created during the project by the partner organizations. It is a unique teaching instrument, encouraging entrepreneurial skills and innovativespirit among students. After the workshop, the participants (students and mentors)were surveyed, using the specially designed questionnaire. One of the question blocks involved the list of competencies, which were offered for evaluation according to the criterion «progress», using 5-point scale (1 –the level stayed the same; 5 –the level really increased). The results were processed, using the methods of frequency analysis and ranking. Thus, the main goal of the paper is to reflect the results of the conducted survey in order to test the quality and success of the specific teaching method. The results indicated the substantial perceived increase in such competences, as Collaborative working, Decision making & Problem-solving, Managing Performance, Commitment to Excellence, Speaking and Listening Skills, Presentation Skills, as well as Self-motivation. The obviousconclusion is that such kind of interactive teaching methods isthe most valuable in management teaching. However, additional peer consulting and evaluation block could be useful at the stage of the initial presentation of the business idea. The results of the research (and the idea of such workshop) can be useful for any academic staff member engaged into the study process and working with students of programmes «Entrepreneurship», «Management», «Business economics»and related ones.publishersversionPeer reviewe

    Circular and carbon-neutral economic development are the topical areas of implementing the climate strategy in many countries. According to these concepts, the main basis for economic development is the growth of the renewable energy share in the structure of energy consumption. The fact that Ukraine has announced that in the future its evolution will be determined by the European integration vector of development means that a prerequisite for the transition to the next steps of development is the synchronization of the national energy policy in accordance with the strategic guidelines of the European region. To develop an effective roadmap for harmonising Ukrainian and European standards of energy market regulation, it is advisable to analyse the experience of implementing energy efficiency practices in the policies of other countries in the European region. The authors forecast the structure of energy production from renewable sources, based on empirical calculations. The development and implementation of modernized mechanisms for regulating the energy market in European countries is a prerequisite for the successful adaptation of the Ukrainian energy sector and the introduction of effective approaches to the management of local businesses and all industries that depend on energy resources

    Competence-based approach to study process is frequently discussed topic among academicians, learners and government authorities due to its practical contribution to better graduates’ employment abilities. The aim of the given study is to identify teaching methods with the biggest contribution to development of students’ competencies. Bachelor level students of management-based study courses were surveyed in order to evaluate the progress in acquiring certain management competencies.     Investments in intellectual capital, such as advertising, R&D, staff training and software, positively affect a company’s value. The aim of this research is to evaluate the perceived importance of expected results from intellectual capital investments by Latvian entrepreneurs and reveal the difference in perceptions caused by differing company profiles. Representatives of Latvian companies were surveyed using the questionnaire developed for the research. Respondents’ answers were evaluated within groups based on profile criteria such as the company’s age, size, financial performance, location and business sector.     Proportionality of Intervention and the Balance of Public and Private Interests in Covert Evidence Collection in Criminal Proceedings

    The article addresses problematic issues of proportionality of interference and the balance of public and private interests during covert evidence collection in criminal proceedings. The relevance of this topic is driven by the fact that, in the context of contemporary challenges related to security, digitalization, and globalization, covert investigative (search) actions should be considered indicators of adherence to the balance of public and private interests during criminal procedural activities. The aim of the article is to provide a scholarly understanding of ensuring proportionality of interference and balance of public and private interests in criminal proceedings during covert evidence collection. The following scientific methods were used to achieve this purpose and accomplish the related objectives: dialectical, formal-legal, formal-logical, analysis and synthesis, and inductive. The empirical basis of the research comprises the most relevant and significant positions of the cassation court concerning covert evidence collection, which are perceived as guidelines and, consequently, as indicators of trends in the national law enforcement system. The authors examine the Supreme Court's positions on specific procedural issues related to interference with private communication, identifying a trend toward emphasizing public interest. Analyzing critical decisions of the cassation court on the appropriate limits of procedural confidentiality allows the authors to conclude that protecting the confidentiality (secrecy) of the technical component in covert investigative (search) actions, though justified for specialized technical means, cannot be considered proportionate concerning the carriers of obtained results. The procedural analysis of issues related to crime provocation highlights the cassation court's practice of using a comprehensive approach to consider the circumstances of covert operations and the diligence and fairness of the prosecution's procedural conduct within the adversarial court process, which is actively used to assess the presence or absence of elements indicating crime provocation. Based on the analyzed material, the study identifies procedurally significant trends and prospective directions for further research

    Use of Information from Electronic Media in Criminal Proceeding of Several European States: Comparative Legal Research

    Investigation of criminal offenses is becoming increasingly associated with the use of information in electronic form. Electronic evidence becomes an integral part of the normative basis of criminal proceeding. The article is devoted to the comparative legal study of the use of information from electronic media in criminal proceeding of several European states. First, the experience of “classical” states of the continental legal system (France, Germany, and Italy) was highlighted. Further, the study of the Baltic region states experience was carried out in relation to each of the states not in isolation, but according to the most favorable structure for comparison. After that some general trends and the most striking problems with the subject were shown. General conclusions related both to signs of electronic evidence and to the most demanded procedural mechanisms for obtaining such data were madeРозслідування кримінальних правопорушень все частіше асоціюється з використанням інформації в електронній формі. Електронні докази стають невід’ємною частиною нормативної основи кримінального провадження. Стаття присвячена порівняльно-правовому дослідженню використання інформації з електронних носіїв у кримінальному провадженні кількох європейських держав. Спочатку було висвітлено досвід «класичних» держав континентальної правової системи (Франція, Німеччина та Італія). Далі, вивчення досвіду держав Балтійського регіону проводилось стосовно кожної з держав не ізольовано, а за найбільш сприятливою структурою для порівняння. Після цього були показані деякі загальні тенденції та найяскравіші проблеми з темою.     Remote criminal trial – fair trial?

    CC BYOne of the most important procedural rights of the individual, without which it would be impossible to defend all other potentially violated individual rights, including those potentially violated during a pandemic, is the constitutional right to a court enshrined in Article 6 of the European Convention on Human Rights and Article 47 of the European Union Charter of Fundamental Rights. The health crisis has plagued many judicial systems in the absence of specific regulations that would provide a clear answer to the question of how to pursue justice in court, and especially to what extent it is possible to use the form of remote – working. This article, analyzes the question of whether the entire criminal trial can take place remotely and, if yes, whether remote criminal trial meets the requirements of due process: both substantive and procedural. The article analyzes the basic requirements of a fair trial, such as the right to be present and be heard, the right to defense; the right to trial within a reasonable time; the right to a public trial. However, even after all issues have been resolved, a more in-depth discussion on the compliance of entire remote criminal proceedings with the principles of a fair trial is needed. The practical analysis of the scientific problem is based mainly on the legal regulation of ECHR and relevant case law of the ECtHR, as well as the experience of two well-known to the authors jurisdictions - Lithuania and Ukraine - in the context of the pandemic
