    Government Partnerships With Faith-based Service Providers: The State of the Law

    Rapid change and significant uncertainty are the most noteworthy features of the legal environment for participation by faith-based organizations ("FBOs") in government-financed socialservices. Developments in federal constitutional law, statutorily based federal programs, and the administrative environment have altered the legal circumstances in which such opportunities mayappear. In addition, the body of law (federal, state, and local) concerning the employment relation, an emerging focus on state constitutional law, and the existing pattern of contractual relations between government entities and FBOs, contribute to an atmosphere of legal complexity surrounding this field. These patterns of change and uncertainty play a crucial role in the decisions of FBOs on the value and risks involved in participating in such programs, as well as in decisions by government agencies concerning whether and how to undertake such programs.The topics included are 1) the Establishment Clause of the First Amendment to the U.S. constitution, including recent cases involving the application of that Clause to FBOs in service partnerships with government; 2) state constitutional law as a source of impediments to state relationships with FBOs, and federal constitutional challenges to such impediments; 3) the law of employment discrimination – federal, state, and local – as it applies to FBOs in such partnerships; 4) federal programs that explicitly invite participation by FBOs; and 5) state social service contracts with FBOs, and the presence or absence of religionspecific provisions in such contracts

    Historic Preservation Grants To Houses Of Workship: A Case Study in the Survival of Separationism

    Many states have historic preservation regulations that, as applied to properties owned by religious entities, have been challenged on free exercise grounds. Historic preservation programs, however, also include government grants for preservation efforts, and no court has yet been asked to rule on the permissibility of such grants. This Article analyzes the existing Supreme Court precedent on state financial support for the construction or preservation of places of worship or religious teaching. After briefly reviewing the movement from Separationists to Neutralism, this Article collects and appraises materials on historic preservation, which reveal a remarkable degree of disparity in preservation policies, as various levels of government struggle with changes in the relevant law. This Article concludes by invoking a principle of Religion Clause symmetry—what the government may regulate it may also subsidize—and by suggesting that the religionspecific line between permissible and impermissible subsidy (and regulation) should be drawn between the exteriors and interiors of houses of worship

    Auralization of a Supersonic Business Jet Using Advanced Takeoff Procedures

    Recent NASA studies of a supersonic business jet airplane indicated that advanced takeoff procedures could be used to reduce noise at the lateral sideline location to a level at which Chapter 4 noise certification requirements could be met. The studies were conducted with the NASA Aircraft Noise Prediction Program, using an analytical model of the airframe and its engines. The advanced procedure consists of a higher-speed climbout and a programmed thrust lapse in which the engine thrust is automatically and gradually reduced immediately after the runway obstacle is cleared. In this paper, the authors utilize the results of the most recent study as the basis of an auralization of the predicted noise. Modifications to the NASA Auralization Framework necessary for that process are described. The auralizations are used to demonstrate differences between standard and advanced takeoff pro ond those that may be observed through comparison of integrated noise metrics

    By purifying the firefly luciferase extract and adding all necessary chemicals but ATP in excess, an assay for ATP was performed by measuring the amount of light produced when a sample containing soluble ATP is added to the luciferase reaction mixture. Instrumentation, applications, and basic characteristics of the luciferase assay are presented. Effect of the growth medium and length of time grown in this medium on ATP per viable E. coli values is shown in graphic form, along with an ATP concentration curve showing relative light units versus ATP injected. Reagent functions and concentration methods are explored. Efforts to develop a fast automatable system to detect the presence of bacteria in biological fluids, especially urine, resulted in the optimization of procedures for use with different types of samples

    Refining the M_BH-V_c scaling relation with HI rotation curves of water megamaser galaxies

    Black hole - galaxy scaling relations provide information about the coevolution of supermassive black holes and their host galaxies. We compare the black hole mass - circular velocity (MBH - Vc) relation with the black hole mass - bulge stellar velocity dispersion (MBH - sigma) relation, to see whether the scaling relations can passively emerge from a large number of mergers, or require a physical mechanism, such as feedback from an active nucleus. We present VLA H I observations of five galaxies, including three water megamaser galaxies, to measure the circular velocity. Using twenty-two galaxies with dynamical MBH measurements and Vc measurements extending to large radius, our best-fit MBH - Vc relation, log MBH = alpha + beta log(Vc /200 km s^-1), yields alpha = 7.43+/-0.13, beta = 3.68+1.23/-1.20, and intrinsic scatter epsilon_int = 0.51+0.11/-0.09. The intrinsic scatter may well be higher than 0.51, as we take great care to ascribe conservatively large observational errors. We find comparable scatter in the MBH - sigma relations, epsilon_int = 0.48+0.10/-0.08, while pure merging scenarios would likely result in a tighter scaling with the dark halo (as traced by Vc) than baryonic (sigma) properties. Instead, feedback from the active nucleus may act on bulge scales to tighten the MBH - sigma relation with respect to the MBH - Vc relation, as observed.Comment: 27 pages, 15 figures, ApJ accepte
