    En la presente tesis se busca identificar principalmente cuales son los patrones de venta de los productos de la tienda Pizza Hut Chiclayo en el periodo octubre 2012 – marzo 2013 para reducir las mermas en el almacén y mejorar así el manejo de insumos en la empresa. Esto permitirá conocer el tipo de gestión, detallar la participación en la venta de cada producto y analizar el control de mermas actual. Se realizará dicha investigación utilizando un análisis descriptivo de toda la información recopilada en este periodo de estudio, y se procederá a pasar dicha información a gráficos del programa Excel y tablas dinámicas para un mejor entendimiento en el proceso de análisis. En el primer capítulo se muestra la problemática real por la cual la empresa está pasando y al mismo tiempo como se llegara a la solución del problema. En el segundo capítulo se manifestó conceptos claves y teorías básicas para un mejor entendimiento; el tercer capítulo es la metodología utilizada para el desarrollo de esta investigación. En el cuarto y quinto capítulo se muestra el proceso actual de gestión y el procesamiento de base de datos de como se ha estado manejando el proceso de venta y desecho en el periodo de estudio, toda esta información se analizó y desarrolló en el transcurso de esta investigación. Y por último el sexto capítulo es la propuesta basada en conclusiones de acuerdo a lo investigado; esta propuesta se basa en ideas precisas las cuales se manifiestan como puntos clave en la investigación, permitiendo así la mejora continua para la parte administrativa de la empresa

    Prevalence and distribution of odontogenic cysts in a Mexican sample. A 753 cases study

    Odontogenic cysts (OC) are the most frequent lesions of the jaws and their constant epidemiological update is necessary and indispensable. Therefore the principal objective of this report was To determine prevalence and clinical-demographical characteristics of OC in a Mexican sample. 753 cases of OC coming from the archive of a head and neck histopathological teaching service, from January 2000 to December 2013, were included. OC cases were re-assessed according 2005 WHO classification. Chi square test was used to establish possible associations (p<0.05IC95%). From 753 OC, 369 were female and 384 male; 52.9% of them were in their 2nd- 4th decade of life. The most common location (41%) was the mandibular posterior area. Radicular cysts were more frequent in maxillary anterior zone of females (p 0.0002) at their fourth decade of life. Dentigerous cysts were more frequent in the mandibular posterior zone of males (p 0.0000) in their second decade of life. Six cases of periodontal lateral cyst; 4 cases of paradental cysts; 4 eruption cysts and 4 cases of adult gingival cyst, as well were identified. Radicular cyst and dentigerous cyst are the most prevalent odontogenic cyst in this Mexican sample. Due to their etiology, dental pulpar necrosis and impacted teeth, radicular cyst and dentigerous cyst could be prevenible. Therefore, it is necessary to establish preventive strategies to diminish dental decay and programs of prophylactic extractions of impacted teeth, to in consequence decrease the prevalence of odontogenic cysts

    Public Policy Defense and the Arbitrability of Competition Disputes Under the Philippine Arbitration Regime

    The arbitrability of anti-competition disputes in the Philippines remains to be tested. It is since the Philippine Competition Act is relatively at its infancy, and cases are yet to be brought before the courts. This area entails much complexity considering that competition disputes are by nature imbued with public policy concerns, a mandatory exception for arbitration. This paper aims to examine the arbitrability of competition disputes under the Philippine domestic arbitration regime. After conducting an examination of cases and literature both in the Philippines and abroad, the paper argues that the Philippines may consider the US and French positions as to the arbitrability of competition disputes despite the presence of various public policy concerns. The public policy issues should only be taken into consideration when an arbitral award is brought before judicial bodies for recognition and enforcement and should not bar domestic arbitral bodies from taking cognizance of these disputes. It is to accommodate the state policy regarding alternative means of settling disputes such as arbitration in rendering speedy administration of justice. Whenever an award is granted, the same will be subject to court's intervention for recognition with due respect to the public policy concerns. In so doing, arbitration is being promoted without sacrificing the competition law policy of the Philippines

    The Influence of Transjudicial Conversation in the Cross-fertilization of Philippine Human Rights Jurisprudence

    Transjudicial conversation refers to the domestic court's judicial practice of cross-citing foreign decisions on common and shared human rights issues. Scholars have argued that this phenomenon facilitates the cross-fertilisation of rights norms and standards across territories. While this has been documented and studied in various jurisdictions, its incidence and effect in the Philippine context is yet to be fully understood. The paper thus seeks to explore the extent of such influence in the Philippine setting, specifically in the development of domestic human rights jurisprudence. In order to examine its impact, this research employs a qualitative research design. Select cases on free speech and religious exercise rights were analysed using doctrinal and content analysis approaches. These cases were purposively chosen, considering that Philippine provisions on these rights have shown close affinity with foreign constitutions. The analysis reveals that the participation of the Philippine Supreme Court in the transjudicial conversation phenomenon generally causes the cross-border fertilisation of human rights norms. Particularly, the impact of this engagement contributes to filling the gap in the domestic understanding of human rights concepts, expanding existing legal systems such as human rights and penal laws, and aligning national human rights systems with international laws. Such impacts enrich the domestic understanding of free speech and religious rights, specifically drawing bright lines between legitimate state intervention and individual enjoyment of the rights

    The Migration of Human Rights Norms: Understanding the Causes of Transjudicial Conversation in the Philippine Context

    This paper explores the causes of transjudicial conversation phenomenon on human rights norms in the context of the Philippine Supreme Court. Transjudicial conversation refers to a judicial occurrence where a domestic court cross-cites foreign judicial opinions. Analysis of the decisions delivered by the Philippine High Court from 1987 to 2019 on issues involving free speech, religious freedom, and environmental rights revealed that the court is an interlocutor in the transjudicial conversation phenomenon. The examination of these cases alongside relevant literature showed that the motivations behind this engagement might be attributed to the genealogical linkages between the domestic rights guarantees and their foreign counterparts, the historical-political alliances between the interlocutor courts, the constitutional system of the borrowing courts, and the foreign academic trainings of the judge who pens the decision

    Esta tesis titulada: “Propuesta de estrategias innovadoras basadas en la teoría de sistemas para mejorar la gestión de la institución educativa Manuel Fidencio Hidalgo Flores de Nueva Cajamarca”, tiene como objetivo proponer estrategias innovadoras basadas en la teoría de sistemas para mejorar la gestión educativa. Esto en respuesta al problema reflejado en las limitaciones en la gestión, en la que se observó el desconocimiento de estrategias que posibiliten conducir con integridad, calidad y sobriedad a la institución en mención. Por ello, se planteó el siguiente problema de investigación: ¿Con la propuesta de estrategias innovadoras basada en la teoría de sistemas se mejorará la gestión educativa de la LE. MFHF de Nueva Cajamarca? En el marco teórico se consideró información relacionada con la teoría de sistemas y la gestión. En el marco metodológico, esta investigación es de tipo descriptiva-propositiva, por cuanto busca describir la realidad de la institución en forma diagnóstica y a partir de ello proponer estrategias innovadoras. En referencia a la población se ha involucrado a docentes, directivos, alumnos y administrativos. La muestra se ha obtenido a través del procedimiento probabilístico, método estratificado valiéndose de la estadística ínferencial. A esta, se aplicó diferentes instrumentos como la ficha de observación, aplicada a los procesos; la guía de entrevista a los directivos; la encuesta a docentes, administrativos y estudiantes. En cuanto a los resultados, se presentan en tablas y gráficos, su interpretación y discusión, en ello se confirman la necesidad de un nuevo modelo de gestión que responda a las necesidades de los estudiantes. En tal sentido, concuerda con la hipótesis si proponemos estrategias innovadoras basadas en la teoría de sistemas entonces mejoraríamos la gestión de la LE. MFHF de Nueva Cajamarca
